How buying works
- 1
Check that you may buy
EU, EFTA and OECD citizens and companies buy freely. EU candidate state citizens need a reciprocity decision. Others can only inherit, with reciprocity.
- 2
Make an offer
Send a written offer (ponudba za nakup) to the seller or agent. Then sign a preliminary contract (predpogodba) with a deposit (ara), or skip it.
- 3
Offer pre-emption rights
The seller may first have to offer the property to the municipality in a pre-emption zone (not for a condominium flat) and to co-owners.
- 4
Sale contract (prodajna pogodba)
It must be in writing. A notary, a lawyer or the agent drafts it. A notary often holds the price (notarska hramba) until the buyer has paid in full.
- 5
Pay the 2% transfer tax
The seller files the real estate transfer tax return within 15 days of the contract.
- 6
Certify the seller's signature
After the tax is paid, a notary certifies the seller's signature on the registration consent (zemljiškoknjižno dovolilo).
- 7
Register the buyer
Ownership passes only on registration in the land register (zemljiška knjiga). The notary usually files the application, which must be electronic.

How renting works
- Lease under the Housing Act (SZ-1)
- Written, with the art. 91 items, including termination grounds. Fixed or indefinite. The Obligations Code fills gaps.
- Rent and deposit (varščina)
- Free, but usurious if over 50% above the municipal average market rent. No deposit cap for a market lease.
- Notice without fault
- Tenant: 60 days' written notice, any time, unless the lease differs. Landlord: only by providing another suitable home.
- Landlord, fault grounds
- Grounds in the law or the lease, after a written warning with at least 15 days to remedy. Court if the tenant disputes.
- Fixed-term notarial lease
- Since 1 December 2025, a landlord whose lease is an enforceable notarial deed can seek eviction directly at term end.
- Energy certificate and tourist letting
- The landlord gives it before a lease of 1 year or more. Tourist letting: Hospitality Act (Zakon o gostinstvu).
- Rental income tax, individual landlord
- 25% after a 10% flat cost deduction. If the tenant is an individual, the landlord files by 28 February of the next year.
- Proposed tax cut (ZIURS)
- 15% instead of 25%. Adopted on 11 May 2026 but not in force. A referendum is set for 6 December 2026.
