Residential lease agreement template for Slovenia

Residential lease (private market flat or house) · Najemna pogodba za stanovanje (tržno najemno stanovanje)

A written lease for a home let on the private market, built on the mandatory content of article 91 of the Housing Act (SZ-1): the home and its cadastre identifier, the parties and occupants, the rent and costs, the deposit, maintenance, landlord visits, the termination grounds and the handover.

Use it when an individual or a company lets a flat or a house as a home on the private market (tržno najemno stanovanje), for a fixed or an indefinite term. Do not use it for short-term tourist letting, which falls under the Hospitality Act (Zakon o gostinstvu), or for public rental housing let by a municipality or a housing fund. SZ-1 governs the lease, and the Obligations Code fills the gaps. The state publishes no official model.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • Under the Hospitality Act (Zakon o gostinstvu), in 2027 and 2028 a flat in 14 municipalities, including Ljubljana, Bled, Koper and Piran, may be let to tourists for at most 60 days a year.
  • The 60-day limit applies unless the municipality set a different limit by 31 October 2026. It does not change long-term leases, but it affects owners who choose between the two.
  • The ZIURS act would suspend these day limits for 2027.
  • The Act on Intervention Measures for the Development of Slovenia (ZIURS) would cut the tax on rental income from 25% to 15%.
  • It would cut the tax to 5% for a home let to a resident tenant who lives there and supports a child under 18, or to a tenant under 30 who lives there.
  • The cut does not apply if voters reject the act.
  • ZIURS status: the National Assembly adopted it on 11 May 2026. It is not yet in force. A legislative referendum is set for 6 December 2026.
  • Check the referendum result before relying on the 25% rate or the 2027 short-term letting limits.

Formalities

  1. The lease must be in writing. Both parties sign it, and each keeps a signed copy.
  2. It must contain at least the items in article 91 of SZ-1, including the termination grounds from article 103. No court registration or stamp duty applies.
  3. Since 1 December 2025, a fixed-term lease made as an enforceable notarial deed lets the landlord seek eviction without a lawsuit when it ends unextended.
  4. Before signing a lease of 1 year or more, the landlord must give the tenant a valid energy performance certificate.
  5. In a multi-unit building, the landlord must notify the building manager at once of the tenant's name and the number of occupants.
  6. Company and sole trader landlords, and company tenants, report a lease of 6 months or more to the market register (ETN) by the 15th of the next month.
  7. Individuals do not report to the ETN. A private landlord with an individual tenant files the rental income return with FURS by 28 February of the next year.
  8. If the tenant is a company or another payer that withholds the tax, the landlord does not file that return.

Common mistakes

  • Leaving out the termination grounds of article 103. They are a mandatory item of the lease (SZ-1, art. 91).
  • Letting the fixed term run out without a signed extension. The tenant then has no legal title to the home, and the landlord can apply for an eviction order.
  • Treating the deposit as last month's rent. Agree in writing what the deposit covers and when it is returned, and keep proof of payment.
  • Terminating for unpaid rent without a prior written warning that names the breach and gives at least 15 days to pay.
  • Charging a rent far above the local average. A tenant can ask the municipality to check it and claim back the excess if it is usurious.
  • Skipping the handover report. Without it, the parties cannot prove the state of the home at the start, and deposit disputes follow.
  • Signing a lease of 1 year or more without handing over the energy certificate. The owner risks a fine of 300 euros (ZURE, art. 66).
  • Not listing the tenant's maintenance works (SZ-1, art. 91, 92 and 94). The tenant bears minor repairs from ordinary use (OZ, art. 589(3)). List any others.
