Lease termination letter template for Slovenia

Tenant's notice to end a residential lease · Odpoved najemne pogodbe (najemnik)

The tenant's written notice that ends a residential lease. Under the Housing Act the tenant can give notice at any time, without reasons, with a 60-day notice period, unless the lease sets other terms. The letter also proposes the handover date and asks for the deposit back.

Use it when you rent a home and want to leave before the lease ends, or end an indefinite lease. You need no reason. Check your lease first: article 102 of the Housing Act applies unless the lease agrees otherwise, so the lease may set a different notice period. If you have a fixed-term lease and simply want to leave on its end date, you do not need to terminate it: without a signed extension, you must leave on that date. Landlords cannot use this letter. A landlord may end a lease only for the grounds in the law or the lease, after a written warning, and through the court if the tenant disputes it.

Give the landlord's full name and address as in the lease.

  2. 2.Termination of the lease

    1. 2.1

I, the tenant, give notice to terminate the lease dated Date of the lease for the home at Address of the rented home, under article 102 of the Housing Act and the lease.

No reason is needed. If you add one, keep it short.

Formalities

  1. The notice must be in writing.
  2. Send it so that you can prove receipt: registered mail with return receipt (priporočeno s povratnico), or by hand against the landlord's signed, dated receipt.
  3. Use email only if the lease allows notices by email, and keep the landlord's reply.
  4. To be safe, count the notice period from the day the landlord receives the letter.
  5. If several tenants signed the lease, all of them should sign the notice.
  6. Rent remains due until the end of the notice period.
  7. At the end, return the home with a handover report, meter readings and all keys.

Common mistakes

  • Giving notice by phone or a chat message. The law requires written notice, and you must be able to prove when the landlord received it.
  • Ignoring a different notice period in the lease. The 60 days apply only if the lease does not agree otherwise.
  • Stopping rent payments and expecting the landlord to use the deposit. Rent is due until the notice period ends.
  • Treating the deposit as rent. It covers damage and unpaid costs, not rent, unless both parties agree in writing.
  • Leaving without an exit handover report. Without it, the landlord can claim damage you cannot disprove.
  • Forgetting to close utility accounts in your name and to send the final meter readings.
  • Staying after a fixed term ends without a signed extension. You then use the home without a legal title, and the landlord can apply for an eviction order.

Legal basis

  • Stanovanjski zakon (SZ-1), Uradni list RS, št. 69/03 s spremembami do 57/25, art. 95, 102, 103, 105, 106, 112, 112.a and 113
  • Obligacijski zakonik (OZ), Uradni list RS, št. 97/07 (UPB), 64/16 (odl. US) in 20/18 (OROZ631), art. 604 (return of the leased thing)
