How buying works
- 1
Written offer (offre d'achat)
The buyer sends it to the seller or the estate agent. Under the Civil Code, an unconditional acceptance on the property and the price forms the sale.
- 2
Sale agreement (compromis de vente)
An estate agent or a notary drafts this private contract, usually with a loan condition and a penalty clause. It binds both parties.
- 3
Registration of the compromis
Neither party can withdraw except under the compromis's own conditions. A non-professional must present it for registration within 3 months.
- 4
Notary checks and deed
A notary chosen by the parties checks the title, mortgages and easements, then draws up the deed of sale (acte authentique).
- 5
Transcription
The notary has the deed transcribed at the mortgage office (bureau des hypothèques). This makes the sale binding on third parties.
- 6
Duties
7% of the price: 6% registration and 1% transcription. In Luxembourg City a municipal surcharge applies to some transfers.
- 7
Bëllegen Akt tax credit
Reduces the duties by up to 40,000 euros per buyer, for a home the buyer will live in.

How renting works
- Lease law (home let to an individual)
- Amended law of 21 September 2006. The law of 23 July 2024 reformed it for leases signed from 1 August 2024.
- Form and term
- Written, or void. Fixed-term or open-ended. At its end it runs open-ended unless the landlord has a legal ground.
- Landlord's legal grounds
- Own or family use, a breach by the tenant, or another serious and legitimate reason. A sale of the home is not a ground.
- Rent cap and changes
- At most 5% a year of the invested capital, revalued and depreciated. Adapted only every 2 years, by at most 10%.
- Deposit cap
- 2 months' rent. A written entry inventory is then mandatory.
- Agency fees
- Split 50/50 between landlord and tenant.
- Notice
- Tenant: 3 months. Landlord who needs the home for own use: 6 months, by registered letter.
- Disputes
- Rent: the rent commission (commission des loyers). All other lease disputes: the justice of the peace.
