Lease termination letter template for Luxembourg

Tenant's notice to end the lease · Lettre de résiliation du bail par le locataire

The tenant's letter that ends a residential lease. The notice period is 3 months, unless the lease sets a longer one. A fixed-term lease ends this way only at its term. Once the term has passed, the lease runs for an indefinite period and the tenant can leave at any time with 3 months' notice.

Use it when you rent your home and want to leave. You need no reason. Check first whether your lease is still in its fixed term: if so, the notice can only end it on the end date, unless the lease has an early-exit clause (often called a diplomatic clause) or the landlord agrees. In a legal co-tenancy, use the co-tenant variant and also notify the other co-tenants. The landlord's notice follows other rules: only on a legal ground, and 6 months for own or family use.

Use the landlord's or agent's address given in the lease.

    2. 1.2

Registered letter with acknowledgement of receipt. Subject: termination of the lease.

If you hand the letter over in person, have the landlord sign and date your copy as a receipt.

  2. 2.Notice

    1. 2.1

Dear Sir or Madam, I hereby give you notice of the termination of the lease of Date the lease was signed for the home located at Address of the let home.

  3. 3.Notice period

    1. 3.1

      Optional

As the lease has continued for an indefinite term, or was made for an indefinite term, the termination will take effect on Date the lease ends, after the three-month notice period set by article 1736 of the Civil Code.

Keep exactly one of the three clauses here. Use this one after the fixed term or if the lease has no end date. Respect any longer notice in your lease.

    2. 3.2

      Optional

As the lease was made for a fixed term ending on End date of the fixed term, this termination will take effect on that end date, the three-month notice period being respected.

Use this one during a fixed term. The landlord must receive the letter at least 3 months before the end date, or the lease continues for an indefinite term.

    3. 3.3

Formalities

  1. Write and sign the letter.
  2. For an ordinary lease the law sets no form. Follow any form the lease requires.
  3. The ministry advises a registered letter with acknowledgement of receipt (lettre recommandée avec avis de réception) to prove the date.
  4. A legal co-tenant must notify the landlord by registered letter with acknowledgement of receipt, and the other co-tenants at the same time.
  5. When all co-tenants leave together, each signs.
  6. Send the letter early enough that the landlord receives it at least 3 months before your leaving date, or the longer period in your lease.
  7. Check whether your lease says the period starts on the first day of a month.

Common mistakes

  • Giving 3 months' notice in the middle of a fixed term without an early-exit clause. The landlord can hold you to the rent until the end date.
  • Assuming a notice by email is safe. It may be valid if the lease is silent, but you must prove the landlord received it on a given date.
  • Leaving a co-tenancy without notifying the other co-tenants at the same time as the landlord.
  • Not seeking a replacement as a leaving co-tenant. An ad in two media listing Luxembourg property within 15 days of the notice start counts as an active search.
  • Forgetting to give your new address and bank account for the deposit. A delay caused by the tenant carries no penalty for the landlord.
  • Accepting a landlord's notice without checking the ground. The landlord needs a legal ground, and a sale of the home is not one.
  • Accepting a notice for own or family use that does not quote article 12, paragraph 3. Such a notice is void.

Legal basis

  • Code civil, art. 1736 (3-month notice for a residential lease, unless the written lease sets more)
  • Loi modifiée du 21 septembre 2006 sur le bail à usage d'habitation, art. 12 (continuation of the lease and landlord's grounds), art. 2quinquies and 2sexies (co-tenant's notice), art. 5, paragraph 2bis (deposit return)
