Move-in inventory report template for Luxembourg

Move-in and move-out inventory report · État des lieux d'entrée et de sortie

The written report that describes the home room by room when the tenant moves in and when the tenant leaves, with meter readings and keys. When the lease has a deposit, the law requires a joint, written entry report. Comparing the two reports decides what the landlord may keep from the deposit.

Use it at the start of every lease, and always when the landlord takes a deposit. Use the same form at the exit, so each line can be compared. In a legal co-tenancy, use it also for the interim report when one co-tenant leaves early.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Formalities

  1. Landlord and tenant, or their agents, draw it up together on site and sign it.
  2. With a deposit, the deadline is the day the tenant takes possession, not merely the day the lease is signed.
  3. The law sets no model form.
  4. Each party keeps a signed copy.
  5. Date and number the photos and refer to them in the report.
  6. At the exit, the tenant gives the new address and a bank account for the deposit.

Common mistakes

  • Doing the entry report after the tenant moves in. With a deposit, sign it by the day the tenant takes possession, or the deposit cannot cover damage.
  • Writing "bon état" for every room. Describe each surface and fitting, and note every mark, crack or stain with a photo reference.
  • Leaving out meter readings. Without them, the final charge statement is open to dispute.
  • Charging the tenant for repainting after normal use. The ministry states that ordinary wear of paint and wallpaper is not the tenant's cost.
  • Forgetting to write the tenant's new address and bank account at the exit. A deposit returned late for that reason carries no penalty.
  • Letting only one co-tenant sign. Every tenant should sign, so that no tenant can later dispute the report.

Legal basis

  • Loi modifiée du 21 septembre 2006 sur le bail à usage d'habitation, art. 5, paragraphs 2 and 2bis (inventory and deposit) and art. 2ter (co-tenancy pact)
  • Code civil, art. 1730 and 1731 (return of the premises with and without an inventory)
