How buying works
- 1
Agent and reservation
Most homes sell through an estate agent (realitní zprostředkovatel). The buyer often signs a reservation agreement and pays a reservation deposit.
- 2
Escrow and drafting
A lawyer, a notary or a bank should hold the reservation deposit in escrow. A lawyer usually drafts the contracts. A notary is not required.
- 3
Purchase or future contract
The parties sign the purchase contract (kupní smlouva) at once, or first a contract to conclude it later (smlouva o smlouvě budoucí kupní).
- 4
When a future contract comes first
Usually when the buyer waits for a mortgage or the seller must repay one.
- 5
Signature and escrow of the price
The contract is in writing, with all parties' signatures on one document, usually officially verified. The buyer pays the price into escrow.
- 6
Application for entry (návrh na vklad)
One party files it with the cadastral office. The fee is CZK 2,000. The office registers the transfer no earlier than 20 days after it informs the owner.
- 7
Ownership and release of the price
The buyer becomes owner on registration, with effect from the day of filing. The escrow then releases the price. No transfer tax since 26 September 2020.

How renting works
- Governing law
- Civil Code (zákon č. 89/2012 Sb.) from § 2201. A contract cannot cut back the tenant's rights in §§ 2235 to 2301.
- Written form
- Required, but the landlord cannot rely on a missing written form.
- Rent limits
- No cap. Increases follow the lease or the statutory procedure: up to local comparable rent, at most 20% over 3 years.
- Deposit cap
- The deposit (jistota) and any contractual penalties together: at most 3 months' rent. The deposit earns interest.
- Tenant notice
- 3 months, with no reason needed, for a lease of indefinite duration.
- Landlord notice
- 3 months, only on grounds the Code lists, with a written statement of the tenant's right to ask a court to review it.
- Service charges
- Paid as advances and settled each year under zákon č. 67/2013 Sb.
- Fast eviction (rozkaz k vyklizení)
- Since 1 January 2026 a court can issue an order against a former tenant who stays after the lease ends.
