Lease termination letter template for Czechia

Tenant's notice to end a flat lease · Výpověď z nájmu bytu (nájemcem)

The tenant's written notice that ends a lease of a flat. For a lease of indefinite duration the tenant needs no reason. For a fixed-term lease the tenant must state a change of circumstances. The notice period is 3 months and starts on the first day of the month after the landlord receives the notice.

Use it when you rent a flat as your home and want to leave. Choose the first alternative for a lease of indefinite duration and the second for a fixed-term lease that you must leave before its end date. If the landlord agrees, a written termination agreement (dohoda o skončení nájmu) can end the lease on any date instead. If the landlord seriously breaches the lease or the flat becomes unusable, you may have a right to end the lease without a notice period. Get legal advice before you rely on it.

Formalities

  1. The notice must be in writing, signed, and must reach the landlord (OZ § 2286(1)).
  2. Send it by registered post with a delivery receipt (doporučeně s dodejkou), or hand it over against the landlord's signed, dated receipt on a copy.
  3. A plain e-mail is risky, because you must prove that a signed written notice reached the landlord.
  4. A data box message is another option if the lease provides for delivery through data boxes.
  5. Each co-tenant who signed the lease should sign the notice.
  6. The 3-month period runs from the first day of the calendar month after delivery.
  7. Pay rent and service advances until the lease ends.

Common mistakes

  • Counting the 3 months from the day you send the letter. The period starts on the first day of the month after the landlord receives it.
  • Sending only an e-mail or a text message. If the landlord denies receipt, you cannot prove a signed written notice reached them.
  • Giving notice of a fixed-term lease without a reason. The tenant may end it early only for a change of circumstances, and must describe that change.
  • Stopping rent payments during the notice period, or using the deposit as the last months' rent without the landlord's agreement.
  • Leaving without a move-out report. Without it, you cannot easily contest the landlord's deductions from the deposit.
  • Forgetting to give a new address. The landlord sends the final service charge settlement up to 4 months after the billing period.
