Buying

  • ChecklistBuyer's due diligence checklist

How buying works

  1. 1

    Written offer (offre d'achat)

The buyer usually starts here. Under the Civil Code, the sale is formed when the seller accepts it without changes on the property and the price.

  2. 2

    Sale agreement (compromis de vente)

A notary or an estate agent drafts this private agreement. It is a binding sale, often subject to a loan condition.

  3. 3

    Deposit into escrow

The buyer pays a deposit, usually 5% to 10% of the price, into the notary's escrow account.

  4. 4

    Notary searches

Each party may choose its own notary. The notary orders the planning information, the mortgage search and the certificates.

  5. 5

    Deed of sale (acte authentique)

The parties sign it before the notary. Sign within 4 months of a private agreement to avoid registering that agreement separately (SPF Finances).

  6. 6

    Duties in Brussels and Wallonia

12.5%. Brussels gives an allowance on the first EUR 200,000 for a main home up to EUR 600,000. Wallonia charges 3% on the buyer's only home.

  7. 7

    Duties in Flanders

Duties are regional. Flanders charges 2% on the buyer's only home.
