Residential lease agreement template for Sweden

Residential lease under the Private Letting Act · Hyresavtal för bostad enligt privatuthyrningslagen

A lease for a home let by a private owner under the Private Letting Act (privatuthyrningslag, SFS 2026:772). It sets the parties, the home, the term, the agreed rent and any index clause, the deposit, notice of 3 months, the tenant's duties, the board's consent for a bostadsrätt and the move-out terms.

Use it when you, as a private person, let your own house, bostadsrätt or ägarlägenhet as a home, furnished or not. Do not use it when you sublet a flat you rent yourself (hyresrätt), when you regularly let more than two homes, when a company lets, or for a holiday let. Chapter 12 of the Land Code then applies instead, with its own rules on rent and security of tenure. Do not use it for a lodger in your own home without adjusting it. A lease signed before 1 July 2026 stays under the old Act (SFS 2012:978).

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

If furnished, attach an inventory of the furniture.

  3. 3.Applicable law

    1. 3.1

This lease is governed by the Private Letting Act (2026:772). The landlord is a natural person who does not regularly let more than two homes outside their own home and does not hold the home as a tenant.

If this statement is false, Chapter 12 of the Land Code applies, and the tenant can gain security of tenure and utility-value rent.

  4. 4.Use

    1. 4.1

The home may be used only as a home for the tenant and the household, Number of people living in the home persons in total.

Using the home for another purpose, after a request to stop, is a ground for early termination (Privatuthyrningslag 6:3).

  5. 5.Term and notice

    1. 5.1

      Optional

The lease runs from Start date until further notice. Either party may give notice to end the lease at the month end that falls at least three months after the notice.

Keep this clause or the next one, not both.

    2. 5.2

      Optional

The lease runs from Start date to End date of a fixed term inclusive and then ends without notice. The tenant may give notice to end the lease early at the month end that falls at least three months after the notice.

Use a fixed term when you need the home back on a set date. The landlord may end it early only on the grounds in Privatuthyrningslag 6:3.

    3. 5.3

Notice must be in writing. The tenant may give notice orally if the landlord confirms it in writing.

  6. 6.Rent

    1. 6.1

The rent is Monthly rent in kronor kronor per month. The rent includes: What the rent includes.

The rent must be a fixed amount (Privatuthyrningslag 2:1). A rent substantially higher than comparable private lets can be cut by the rent tribunal.

    2. 6.2

      Optional

In addition to the rent, the tenant pays compensation equal to the cost of consumption of the following: Consumption charged at cost.

Heating, cooling, hot water, electricity, water and sewage may be billed by consumption at actual cost. The base rent stays fixed (Privatuthyrningslag 2:1).

  7. 7.Payment

    1. 7.1

The rent is paid in advance no later than the last working day before the start of each calendar month to Account for rent payments.

Give a bank account, bankgiro or Swish number. Payment through a bank counts as received when the bank accepts the order (Privatuthyrningslag 2:3).

  8. 8.Index clause

    1. 8.1

      Optional

The rent may be adjusted in line with the change in the consumer price index (KPI) from Base month of consumer price index (KPI). The party who wants to change the rent must notify the other party in writing and, on request, show the calculation. The new rent applies from the month end falling at least one month after the notice, and the previous rent must have applied for at least one year.

Without it the rent stays fixed unless the tenant applies to the rent tribunal. The index works both ways. The base month is usually the signing month.

  9. 9.Deposit

    1. 9.1

      Optional

The tenant pays a deposit of Deposit in kronor kronor as security for the tenant's obligations under the lease. The deposit is repaid no later than Days after move-out to return deposit days after move-out, less only unpaid rent and damage for which the tenant is liable and which is shown in the move-out inspection.

The law sets no cap and no deadline. Match the amount to the rent and furniture. Keep it on a separate account and state the return deadline here.

  10. 10.Condition of the home and inspection

    1. 10.1

The home is let in the condition stated in the inspection report that the parties draw up and sign at the start of the lease. During the lease the landlord must keep the home in that condition.

For a defect the tenant can claim repair, rent reduction or damages, and end the lease at once if a material one is not fixed fast (Privatuthyrningslag 3:2-6).

  11. 11.Tenant's duties

    1. 11.1

The tenant must take good care of the home and pay for damage caused by the fault or negligence of the tenant, a member of the household, guests or anyone working for the tenant. The tenant must notify the landlord at once of damage or defects that need urgent repair, and of other damage as soon as possible.

      These duties follow Privatuthyrningslag 4:2-4.

    2. 11.2

The tenant must follow the house rules of the housing association or the joint property association and must not disturb neighbours. The tenant may not sublet the home or transfer the lease without the landlord's written consent.

    3. 11.3

      Optional

The tenant must hold home contents insurance for the whole term of the lease.

Recommended. A breach of an extra contractual duty justifies early termination only if it is of special importance to the landlord (Privatuthyrningslag 6:3).

  12. 12.Landlord's access

    1. 12.1

The landlord has the right of access to the home for necessary inspection and for urgent works. When the home is available for letting or is to be sold, the tenant must allow it to be shown at a suitable time.

Privatuthyrningslag 4:7 applies JB 12:26. The duty to allow viewings for a sale is stated there for an ägarlägenhet; agree viewings for other sales here.

  13. 13.Early termination

    1. 13.1

The landlord may give notice to end the lease with immediate effect on the grounds set out in chapter 6, section 3 of the Private Letting Act, among them if the tenant is more than two weeks late with the rent or sublets the home without consent.

For most grounds the tenant must first be asked to put things right. Minor breaches do not count.

  14. 14.Moving out

    1. 14.1

When the lease ends, the tenant must, no later than 12.00 on the following day, leave the home well cleaned, return all keys and take part in a move-out inspection.

If that day is a weekend or public holiday, the next working day applies (Privatuthyrningslag 6:12).

  15. 15.Consent to the let

    1. 15.1

      Optional

The landlord has obtained the following consent or permission for the let: Consent to let. If the consent or permission ends, the landlord may give notice to end the lease, observing the notice period stated above.

Keep for a bostadsrätt. Give the board's consent with date and period, or the rent tribunal's decision. Sign after consent, or make the lease conditional on it.

  16. 16.Notices

    1. 16.1

The parties give the following electronic addresses to which notices and terminations relating to this lease may be sent: Email addresses for notices. A party who changes address must tell the other party at once.

Give one address for each party. A notice sent to an address given for this purpose counts as given when sent (Privatuthyrningslag 6:8, 7:2).

  17. 17.Other terms

    1. 17.1

      Other terms

A term that is worse for the tenant than the Private Letting Act has no effect against the tenant.

  18. 18.Signatures

    1. 18.1

This lease has been drawn up in two identical copies, of which each party has taken one. Place of signature, Date of signature. Landlord's signature. Tenant's signature.

Formalities

  1. The law requires a written lease only if one party asks for it (Privatuthyrningslag 1:5). Always make one.
  2. Sign two copies, one for each party. No registration, stamp duty or witnesses apply.
  3. A bostadsrätt owner needs the board's consent before letting, or the rent tribunal's permission if the board refuses (Bostadsrättslagen 7:10-11).
  4. The board's consent is often limited in time. Check its end date before you sign the lease.
  5. A married owner needs the spouse's consent to let the couple's home (Äktenskapsbalken 7:5).
  6. Show the tenant the energy declaration where the law requires one for the building, and state the energy performance in the advert (Lag 2006:985, 13 §).

Common mistakes

  • Following pre-July 2026 guidance. Many pages still give the old cost-based rent cap and 1-month tenant notice. They apply only to leases under SFS 2012:978.
  • Letting a bostadsrätt without the board's consent. The association can then end the owner's right to the flat.
  • Using this lease to sublet a rented flat (hyresrätt). Chapter 12 of the Land Code applies instead, and you need the landlord's consent.
  • Charging a subtenant of a hyresrätt more than your own rent plus up to 15% for furniture (Jordabalken 12:55).
  • Giving the tenant less than 3 months' notice in the lease, or other terms worse for the tenant than the Act. They have no effect (Privatuthyrningslag 1:4).
  • Choosing an open-ended lease when you need the home back on a set date. Use a fixed term; the tenant can still leave early with 3 months' notice.
  • Charging a rent far above comparable private lets. The tenant can have it cut from the day of the application, and you repay the excess with interest.
  • Skipping the move-in inspection. Without a signed record of the condition, you will struggle to prove that damage arose during the lease.

Legal basis

  • Privatuthyrningslag (2026:772), in force 1 July 2026
  • Lag (2012:978) om uthyrning av egen bostad, 3 § (notice under the old Act)
  • Jordabalk (1970:994), 12 kap. 1 c § och 26 § (Chapter 12 does not apply to private lets; landlord's access)
  • Bostadsrättslag (1991:614), 7 kap. 10-11 §§ (letting a bostadsrätt)
  • Äktenskapsbalk (1987:230), 7 kap. 5 § (spouse consent to let the common home)
  • Lag (2006:985) om energideklaration för byggnader, 5 och 13 §§
