Purchase offer template for Slovakia

Offer to purchase a property · Ponuka na kúpu nehnuteľnosti

A written, signed offer from the buyer to the seller that states the property, the price, the financing, the timetable and a validity date. The seller can accept it in writing. It prepares the contract to conclude a future purchase contract or the purchase contract. It does not transfer the property.

Use it after a visit, when you want to state your price and conditions in writing before the parties pay for a lawyer's draft. The law does not require it. Send it to the seller, or to the estate agent who acts for the seller. If the agent offers you a reservation agreement (rezervačná zmluva) instead, read the section on pitfalls first.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

    2. 2.2

The offer assumes that the property carries no mortgage, easement, pre-emption right or lease, except those shown on the ownership sheet that the seller removes before the purchase contract is signed.

Part C of the ownership sheet lists the encumbrances. A bank mortgage is usually paid off from the price through escrow.

Delete it only if you pay entirely from your own funds. Without a written loan condition, a refused loan does not by itself release you.

  5. 5.Next steps

    1. 5.1

When it is signed, the buyer will pay an advance on the price of Advance due at that contract euros into a notary's, lawyer's or bank escrow.

This is a promise to pay later, into escrow. The law sets no rate for the advance. Pay nothing to the seller or the agent now.

    2. 5.2

The parties will sign the purchase contract, with the seller's signature officially certified, by about Target date for the purchase contract. The price will be released to the seller from escrow after the cadastre allows the entry of the buyer's ownership.

The duty to sell and buy the property will arise only when the parties sign a contract to conclude a future purchase contract or a purchase contract, with both parties' declarations on the same document.

This keeps the offer as a statement of terms. If you want the accepted offer to bind both sides, have a lawyer turn it into a contract under § 50a instead.

    2. 6.2

The buyer pays no sum to the seller or to any agent with this offer.

  7. 7.Validity

    1. 7.1

The offer is valid until Date and time the offer expires. If the written acceptance does not reach the buyer by that time, the offer lapses.

At Place of signature, on Date of signature. Signature of the buyer.

    2. 8.2

Acceptance: I agree to this offer on the stated terms. On Date the seller accepts. Signature of the seller.

Every co-owner must sign. A spouse must also sign when the property belongs to the spouses' joint property (bezpodielové spoluvlastníctvo manželov).

Formalities

  1. No form, witness, notary or certified signature is required.
  2. Sign and date the offer. Keep proof of the date the seller received it: a registered letter, an email with a reply, or a signed copy.
  3. The seller accepts by signing the acceptance on this document. Silence is not acceptance.
  4. Pay nothing with the offer.
  5. A purchase contract for real estate needs both parties' declarations on one document, the seller's certified signature and entry in the cadastre.
  6. No certified signature is needed if a lawyer authorises the contract or a notary draws it up as a notarial deed.
  7. An exchange of letters can therefore never transfer the property.

Common mistakes

  • Signing an agency's reservation agreement (rezervačná zmluva) without reading the fee and penalty terms. It is a contract with the agency, not a sale.
  • Not checking when you get the reservation fee back if the loan fails or the seller withdraws.
  • Paying a reservation fee or a deposit in cash or to an account you cannot identify. Pay only into escrow (notary, lawyer or bank) under a written contract.
  • Leaving out the validity date. Without it the offer stays open for a reasonable time, which is open to dispute.
  • Making an offer without a loan condition when you need a loan. If the seller accepts, you start the process at that price.
  • Describing the property without the cadastral data. Use the ownership sheet (list vlastníctva) number, the cadastral area and the parcel or flat number.
  • Treating the seller's reply with a new price as agreement. It is a new offer, and nothing is agreed until you accept it.
