Move-in inventory report template for Malta

Inventory and condition report (Annex A to the lease)

The inventory that every private residential lease must contain: a signed record, with photographs and short descriptions, of the condition of the dwelling and of the furniture and appliances the landlord supplies. The same form records the condition at the end of the lease.

Fill it in with the tenant before the lease starts, room by room, and attach it to the lease as Annex A. It is required for a furnished and for an unfurnished home. Use the same form at the end of the lease, in the departure column, before the landlord returns the deposit.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Formalities

  1. All parties sign the inventory.
  2. It must be documentary evidence of the condition of the dwelling and of the furniture and appliances the landlord supplies.
  3. Photographs need short descriptions. Photographs alone are enough only if they show the condition fully, clearly and unequivocally.
  4. Without an inventory the lease is null (Cap. 604, art. 6(2)).
  5. Each party keeps a signed copy with the photographs.
  6. Date the photographs, or list them by file name in the report.

Common mistakes

  • Skipping the inventory for an unfurnished home. The Act requires it in every case, and the lease is null without it.
  • Taking photographs without descriptions. A photo of a wall does not say which room it is or what defect it shows.
  • Writing "good condition" for every item. Record each scratch, stain, crack and missing part, with its location.
  • Letting only one lessee sign. Every lessor and every lessee must sign.
  • Forgetting the meter readings and meter numbers. Without them, utility disputes at the end of the lease are hard to settle.
  • Doing the exit check without the tenant. Fix a date for the joint inspection when the tenant gives notice.

Legal basis

  • Private Residential Leases Act (Cap. 604), art. 6(1)(g) and 6(2) (inventory as an essential term) and art. 23 (Adjudicating Panel)
  • Civil Code (Cap. 16), art. 1559 to 1563 (condition on return, presumption of good condition, liability for damage)
