Lease termination letter template for Greece

Tenant's notice to end a residential lease · Δήλωση καταγγελίας μίσθωσης κατοικίας από τον μισθωτή

The tenant's written notice that ends a residential lease. A Greek tenant can end the lease only on a ground the law or the lease allows: end of the term after the 3-year minimum, notice on an indefinite lease, or an early-exit clause. It proposes a handover date and asks for the deposit.

Use it when you rent your main home and want to leave. Pick the one ground that fits and delete the others. Before the agreed term and the 3-year minimum have both passed, you can leave early only if your lease has an early-exit clause or the landlord agrees in writing. Otherwise the landlord can claim the rent to the end of the term. The landlord's own notice follows other rules, set out in the key facts.

Key facts

Applies to
Whole country
Fixed term
Ends at the agreed date with no notice (Civil Code art. 608), but never before 3 years for a main home (law 1703/1987, art. 2 para. 1).
Indefinite lease, monthly rent
Notice at least 15 days before a calendar month ends, effective at that month's end, unless the lease says otherwise (Civil Code art. 609).
Staying on after the term
If the tenant stays with the landlord's knowledge and no objection, the lease continues for an indefinite term (Civil Code art. 611).
Leaving early without a right
The lease does not end. The tenant owes the rent to the end of the term or the 3 years, or at best until the home is relet.
Statutory early exit
Only on narrow grounds, such as a serious health risk from the home (Civil Code art. 588) or a civil servant's transfer (art. 613).
Leaving by agreement
A later agreement ends the lease at any time, with no document. Keys accepted without reservation can count (Areios Pagos 2162/2013).
Landlord's grounds
Term end after the 3 years, notice on an indefinite lease, late rent with at least 1 month's notice (art. 597), or careless use (art. 594).
Landlord's own use
No ground lets the landlord end a main-home lease early for the landlord's own use.
AADE declaration of the end
Landlord files it by the end of the month after the lease ends. Tenant accepts online. Until then AADE treats the lease as in force.

Tenant's notice to end a residential lease

  1. 1.Details

    1. 1.1

From Tenant or co-tenants, tenant. To Landlord, landlord.

If a bailiff serves the notice, the heading usually reads "ΕΞΩΔΙΚΗ ΔΗΛΩΣΗ - ΚΑΤΑΓΓΕΛΙΑ ΜΙΣΘΩΣΗΣ" and ends with an instruction to the bailiff to serve it.

    2. 1.2

Under the private lease dated Date of the lease I rent from you, as my main home, the property at Address of the let home. The lease started on Start date of the lease and was agreed to end on Agreed end date of the lease.

Give the tenant's full name, father's name and ΑΦΜ, and the landlord's address for service as in the lease.

  2. 2.Notice

    1. 2.1

      Optional

I give you notice that I do not wish to extend or renew the lease, which ends on Date the lease ends under this notice, when I will return the home to you.

Ground 1: the agreed term ends and at least 3 years have passed since the start. Keep exactly one of the three grounds.

    2. 2.2

      Optional

The lease now continues for an indefinite term. By this notice I terminate the lease under article 609 of the Civil Code, with effect from Date the lease ends under this notice.

Ground 2: the term ended after 3 years and you stayed on. Monthly rent: end on a month's last day at least 15 days after receipt, unless the lease sets more.

    3. 2.3

      Optional

I exercise the right of early termination given to me by clause Early-exit clause number of the lease and terminate the lease with Notice period required by that clause notice, with effect from Date the lease ends under this notice. I will pay the compensation that the same clause provides.

Ground 3: an early-exit clause. Quote its minimum period, notice and compensation exactly. Before 3 years its validity is unsettled, so agree in writing.

  3. 3.Return of the home

    1. 3.1

I invite you to take back the home and the keys on Proposed date and time for the handover, when we will jointly draw up a move-out report with the condition of the home and the meter readings.

Propose a date on or before the end date. Rent is due until the lease ends, even if you leave earlier.

  4. 4.Deposit and AADE declaration

    1. 4.1

Please return my deposit of Deposit paid euros, under the terms of the lease, to the account with IBAN Tenant's IBAN for the deposit. My new address and email are: Tenant's new address and email.

    2. 4.2

Please also file the declaration of the end of the lease with AADE by the end of the month after it ends.

  5. 5.Signature

    1. 5.1

Place: Place of signature. Date: Date of signature. The tenant.

Keep the bailiff's service report, the postal proof of delivery or the landlord's dated signature. The notice period starts when the landlord receives it.

Formalities

  1. Give the notice in writing and keep proof of when the landlord received it.
  2. The surest way is service by a court bailiff (δικαστικός επιμελητής) as an out-of-court statement (εξώδικη δήλωση). It gives a dated service report.
  3. A registered letter with proof of delivery, or delivery by hand against a dated signature, also works.
  4. A notice under a lease clause must follow that clause's form and period.
  5. Each co-tenant who leaves should sign.
  6. After the handover, the landlord declares the end of the lease on AADE's lease system by the end of the following month. The tenant accepts it online.

Common mistakes

  • Leaving before the term or the 3 years end on a verbal promise. Without a lease clause or the landlord's written agreement, the landlord can sue for the rent.
  • Counting the notice from the day you send it. It runs from the day the landlord receives it, so use a method that proves the date of receipt.
  • Assuming the lease ends because the agreed date passed while you stayed on. If the landlord knew, the lease runs on for an indefinite term and needs notice.
  • Leaving without a signed handover report. Ask the landlord to sign the move-out report and accept the keys, so the date and condition are proved.
  • Expecting the deposit to cover the last month's rent. It is not offset against rent unless the landlord agrees in writing.
  • Forgetting the AADE end-of-lease declaration. Check that the landlord files it, and accept it online.

Legal basis

  • Αστικός Κώδικας (Civil Code), arts. 167 (a declaration takes effect when it reaches the recipient), 588, 594, 597, 601, 608, 609, 611 and 613
  • Ν. 1703/1987, art. 2 para. 1, as replaced by ν. 2235/1994, art. 1 para. 5 (3-year minimum for a main home)
