Residential lease checklist for Denmark

Residential lease: checklist for the authorized standard form · Lejekontrakt for beboelse (Typeformular A, 10. udgave)

In Denmark a standardized lease is valid only on the authorized Typeformular A, 10th edition, in Danish or in the official English version from 2025. This checklist follows its sections and lists what to check and fill in: rent rules, deposit and prepaid rent caps, utilities, inspections, maintenance and special terms.

Use it when you let or rent a home from a private landlord. Download the official form, fill it in section by section with this checklist, and put every agreed departure from the law in section 11. The landlord must hand over the energy label before the lease is signed.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • On 26 October 2026 the ministry published a draft order to authorize Typeformular A, 11th edition, in Danish and English, from 1 January 2027.
  • Under the draft, the 10th edition would stay authorized until 1 July 2027.
  • Bill L 34 (2026-27), tabled on 7 October 2026, would let landlords and tenants send these notices digitally through a secure digital post provider.
  • L 34 is proposed to enter into force on 1 January 2027. Until then these notices must be on paper.
Official model: Typeformular A, 10. udgave (lejekontrakt for beboelse), with the English version Typeformular A, 10th edition (ENG)

Authorized under lejeloven § 14 by bekendtgørelse nr. 77 of 29 January 2025, in force 1 February 2025. The English version applies to leases signed after 1 February 2025. A form identical in content and layout also counts as authorized. Børne-, Ældre- og Boligministeriet now publishes both forms.

The checklist

Before you sign

  • Use the current authorized form, Danish or EnglishTypeformular A, 10. udgave

Only this form keeps standard terms valid. Older editions and private templates do not.

  • Energy label of the home handed to the tenantEnergimærke

The law requires it before the lease is signed. It shows the expected heating cost.

  • Which rent rules apply to the homeOmkostningsbestemt leje, det lejedes værdi, fri leje

The rules turn on the year of first use, the size and whether the municipality is regulated. The rent tribunal can cut rent above the cap.

  • House rules, if any, attached to the leaseHusorden

The form asks whether house rules apply. If they do, they must be attached.

  • No payment for getting the leaseDusør, forbud mod nøglepenge

A landlord or an agent may not take money from the tenant for letting the home. The tenant can reclaim it with interest.

Section 1: Parties and the rental unit

  • Names, addresses and contact details of landlord and tenant, and the landlord's CVR number if a companyParterne

Every tenant who signs is a party to the lease.

  • Type of unit: flat, single room, owner-occupied flat, or subtenancyLejlighed, værelse, ejerlejlighed, fremleje

The type decides the notice periods and the landlord's grounds for termination. An owner who may move back must tick owner-occupied flat.

  • Gross floor area, number of rooms and shared facilitiesBruttoetageareal, brugsret til fællesfaciliteter

The area is the basis for many rent rules. List laundry, storage, garage and garden rights.

  • Permitted use of the unitAnvendelse

Other use, such as a business, needs the landlord's written consent.

Section 2: Start and end of the tenancy

  • Start dateLejeforholdets begyndelse

Rent is due from this date, and the 2-week deadline to report defects runs from it.

  • A fixed term only with a reason, stated in section 11Tidsbegrænset lejeaftale

A fixed-term lease ends without notice and cannot be terminated early unless agreed. The housing court can set aside an unjustified term.

  • Notice rulesOpsigelse

Written notice. The tenant gives 3 months, or 1 month for a room in the landlord's own home. The landlord needs legal grounds.

Sections 3 and 4: Rent, deposit and prepaid rent

  • Annual rent, payment date and payment periodÅrlig leje, forfaldsdag

Rent can be required monthly in advance, and never for more than 3 months at a time.

  • Each amount charged on top of the rent, with its legal basisAconto varme, vand, el, antenne, internet

The form warns that any extra amount needs a legal basis. Otherwise it must be part of the rent.

  • Landlord's bank account or BetalingsserviceBetalingssted

Payment into this account counts as payment on time.

  • Deposit of at most 3 months' rentDepositum

It secures the tenant's obligations at move-out. The landlord can raise it when the rent rises, in monthly instalments.

  • Prepaid rent of at most 3 months, and not more than the rent for the notice periodForudbetalt leje

The tenant sets it off against the last months of rent after giving notice.

  • Rent increases by net price index, written in section 11Nettoprisindeksregulering

Index-linked increases need an express term in the lease, and the landlord must notify each increase in writing.

Sections 5 to 7: Utilities and inspections

  • Who supplies heating, hot water, water, electricity and cooling, and how each is measuredVarme, vand, el og køling

Consumption is shared by individual meters and paid on account, or included in the rent. The form states the start of each accounting year.

  • Communal aerial and internet contributionsFællesantenne, internet

State whether the tenant pays a contribution for each.

  • Whether the landlord lets more than one flat, and the move-in inspectionIndflytningssyn og indflytningsrapport

Such a landlord must inspect with the tenant and hand over a move-in report, or lose most move-out repair claims.

Sections 8 to 10: Maintenance, appliances and other terms

  • Who does interior maintenance: painting, wallpaper and floor treatmentIndvendig vedligeholdelse

If the landlord does it, the form shows the balance of the unit's maintenance account. The tenant maintains locks and keys unless agreed.

The form lists the appliances the landlord owns at the start of the tenancy. List each one.

  • Pets, tenant representation and house rulesHusdyr, beboerrepræsentation, husorden

State whether pets are allowed and on what conditions.

Section 11: Special terms

  • Every departure from the law and from sections 1 to 10, written here and nowhere elseSærlige vilkår

A term that reduces the tenant's rights binds the tenant only if section 11 states it.

  • Free rent statement, if the rent is free under § 54Fri leje

For converted business premises and new attic or rooftop flats, the lease must say the unit falls under these rules, or rent is not free.

  • Do not repeat terms that already follow the lawGentagelse af lovens regler

The form says such terms do not belong in section 11. Extra information goes in section 10.

Signing and after

  • Signatures of the landlord and every tenant, each keeping a copy with the guideUnderskrift

The guide is part of the authorized form.

  • Disputes go first to the municipal rent tribunalHuslejenævnet

It decides rent, maintenance, move-out repairs and deposit refunds. Termination disputes go to the housing court.

Formalities

Lejeloven § 14 allows a standard form for flats and rooms only if authorized. A private template offered to many tenants is such a form. Typeformular A is free, so this page is a checklist for it.

  1. Either party can require the lease to be in writing (lejeloven § 11).
  2. The parties sign the form. Each keeps a copy with the guide that is part of it.
  3. No registration is needed. The tenant's rights under the law are valid against any later owner.
  4. The parties may use the English form, but must then fill in every field in English.
  5. Departures from the law that favour the landlord are valid only if section 11 states them.

Common mistakes

  • Writing your own lease from an internet template. If it reads as a standard form, every term giving the tenant fewer rights or more duties than the law is void.
  • Putting a departure from the law outside section 11, or deleting printed text. Such a term does not bind the tenant.
  • Charging extra amounts that have no legal basis, such as a cleaning fee. They must be part of the rent or not charged at all.
  • Agreeing a fixed term without a real reason in the landlord's situation. The housing court can set the time limit aside. The lease then runs until terminated.
  • Letting your own flat without stating that it is an owner-occupied flat. The landlord may then be unable to end the lease to move back in.
  • Taking a deposit or prepaid rent above the caps. The rent tribunal decides such disputes (§ 63).
  • Skipping the move-in inspection as a landlord who lets more than one flat. You then lose the right to charge move-out repairs, except damage the tenant caused.

Legal basis

  • Lov om leje (lejeloven), lov nr. 341 af 22. marts 2022, as amended, §§ 11, 14, 15, 54, 58, 59, 90, 91, 173 and 175
  • Bekendtgørelse om autoriserede standardblanketter for lejeaftaler, BEK nr. 77 af 29. januar 2025
