Purchase offer template for Denmark

Offer to purchase · Købstilbud

A short written offer from the buyer to buy a named property at a stated price, with a deadline for the seller's answer. It states the buyer's conditions: bank approval, approval by the buyer's adviser and a full purchase agreement (købsaftale). It does not replace the købsaftale.

Use it after a viewing, when you want to name your price in writing before the seller or the agent drafts the købsaftale. It is not required by law. In most sales through an estate agent, the buyer makes the offer by signing the agent's draft købsaftale. Then this letter only opens the negotiation. In a private sale without an agent it fixes the price and the conditions before a lawyer drafts the købsaftale.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

The buyer offers a cash purchase price of Offered price in kroner, in figures kroner, in words Offered price in words kroner.

    2. 3.2

The purchase price will be settled by a cash deposit of Cash deposit in kroner kroner, deposited after the purchase agreement is signed, and by a bank guarantee for the rest of the price.

This states how you will pay. Pay nothing with the offer. The law sets no deposit amount. The deposit and guarantee deadlines go into the købsaftale.

  4. 4.Conditions

    1. 4.1

      Optional

The offer is conditional on Your bank or mortgage lender approving the financing of the purchase no later than Weekdays for the bank's approval weekdays after both parties have signed the purchase agreement.

Delete it only if you pay entirely from your own funds. A bank reservation and an adviser reservation are separate. One does not replace the other.

    2. 4.2

The offer is conditional on the buyer's adviser, Your lawyer or buyer's adviser, approving the purchase as a whole. Objections must reach the seller or the seller's estate agent in writing no later than 4 pm, Weekdays for the adviser's approval weekdays after both parties have signed the purchase agreement.

The purchase becomes binding only when the parties have signed a final purchase agreement. By the seller's acceptance of this offer, the parties undertake to negotiate a purchase agreement on the terms stated in the offer.

This clause keeps the offer from becoming a full sale on acceptance. Keep it unless your adviser tells you otherwise.

    2. 6.2

The buyer has been informed of the withdrawal right under the Act on consumer protection in the acquisition of real property, which applies from the conclusion of the agreement.

  7. 7.Deadline for acceptance

The offer is valid until Date and time the offer expires. The seller's written acceptance must have reached the buyer before that time. After it, the offer lapses without further notice.

Set a short, exact deadline with a time of day. Until the seller accepts, you can take back the offer by telling the seller.

    2. 7.2

A reply that changes the price or the terms is a rejection and a new offer.

  8. 8.Signatures

    1. 8.1

Place of signature, on Date of signature. Signature of the buyer.

    2. 8.2

Seller's acceptance: The above offer is hereby accepted on the stated terms, on Date the seller accepts. Signature of the seller.

Formalities

  1. No form, witness or notary is required.
  2. Sign and date the offer. Send it by email or letter to the seller or the seller's agent, and keep proof of when it arrived.
  3. The seller's acceptance must reach you before the deadline in the offer.
  4. A reply that changes the price or a term is a new offer.
  5. For a home for your own use, you can take back the offer until the seller accepts it.
  6. After the seller accepts and a købsaftale exists, you have the statutory 6-weekday withdrawal right against payment of 1% of the price.

Common mistakes

  • Writing an unconditional offer. Once the seller accepts, a binding purchase may exist before your adviser and bank check anything. Keep the reservations in.
  • Setting no deadline. Without one, the offer stays open for the time a reply could normally take, and you do not control when the seller can accept.
  • Making an offer on a house before you have the condition report, the electrical report and the insurance offer. Ask for them first and read them.
  • Relying on the 6-weekday withdrawal right as a free exit. It costs 1% of the price, and the payment must reach the seller within the period.
  • Treating a seller's reply with a new price as an agreement. It is a counter-offer. Nothing is agreed until you accept it.
  • Ignoring your right to buy. Without 5 years in Denmark you need permission or, as an EU/EEA buyer of a year-round home, a declaration to Tinglysningsretten.

Legal basis

  • Lov om forbrugerbeskyttelse ved erhvervelse af fast ejendom m.v., LBK nr. 1123 af 22. september 2015, §§ 2, 6-13
  • Aftaleloven, LBK nr. 193 af 2. marts 2016, §§ 1-6 (offer, acceptance deadline, late and modified acceptance)
