Buyer's due diligence checklist for Denmark
Buyer's due diligence checklistTjekliste før underskrift af købsaftalen
The documents and checks a buyer of a Danish home should have before the adviser reservation expires: land register and easements, the public property data report, planning and soil data, the house inspection reports, the energy label, association documents for a flat, costs and the buyer's own right to buy.
Use it from the first viewing until your adviser approves the purchase agreement. In a sale through an estate agent, the agent collects most documents and attaches them to the købsaftale. In a private sale, the seller collects them, and your adviser checks them. Ask for anything missing before you sign or before the adviser reservation ends.
Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Formalities
A due diligence list is a checklist by nature. Danish law has no notary who collects the searches, so the buyer's adviser or the estate agent does it.
- You do not sign this checklist. The documents become annexes to the købsaftale, and signing it confirms you received them.
- The condition report, electrical report and insurance offer protect the seller only if you received them before the agreement.
- When the building needs an energy label, you must receive it before the sale is agreed. Holiday homes need none.
- Most public data are available with MitID on boligejer.dk and tinglysning.dk.
Common mistakes
- Reading only the condition report summary. The damage grades and notes on the roof, damp and drains decide the real cost. Ask your own surveyor if in doubt.
- Assuming the change-of-ownership insurance covers everything. It does not cover what the report describes correctly. Read the exclusions before you accept it.
- Trusting BBR without checking. A missing extension in BBR can mean it was built without permission. Compare BBR with the building case file.
- Skipping the easements. Old servitutter can restrict building, letting or fences, and some are only on paper at Rigsarkivet.
- Buying a flat without the administrator's answer (ejerlejlighedsskema). It shows planned works, shared loans and rising contributions that the minutes may not.
- Ignoring the new property taxes. Since 2024 the taxes follow the new public valuations. Ask your adviser to estimate your future tax, not the seller's.
- Planning to use a Danish holiday home as a non-resident. Even EU/EEA citizens need Civilstyrelsen's permission, given only for a special connection to Denmark.
