Tenant's notice to end a residential lease · Comunicación de desistimiento o de no renovación del contrato de arrendamiento de vivienda

The tenant's written notice to the landlord that the tenant will leave: either an early exit after the first 6 months, or a refusal to renew at the end of the term or of a yearly renewal. It states the leaving date and asks for the key handover and the deposit return.

Use it when you rent a main home and want to leave. Choose the early exit clause if you leave in the middle of a lease year, after at least 6 months. Choose the non-renewal clause if you leave at the end of the agreed term or of a yearly renewal. Check the start date and the renewal dates of your lease before you choose.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • Since 8 October 2026, LAU art. 11.3 (RDL 29/2026) says that a tenant's early exit gives the landlord no right to compensation.
  • Before, a lease could charge one month's rent for each remaining year.
  • RDL 29/2026 has no transitional rule on this point for leases signed earlier, so a landlord may still rely on such a clause in an older lease.
  • RDL 29/2026 awaits a vote of the Diputación Permanente. If it is rejected, the earlier rule returns for the future.
  • RDL 28/2026 would apply from 15 November 2026 if confirmed. The tenant's 2-month notice at the end of the minimum term stays.
  • Under RDL 28/2026, the landlord would need 6 months' notice and would owe compensation in most cases.

      Optional

By this letter I notify you that, under article 11 of Ley 29/1994 on Urban Leases, and more than six months having passed since the lease dated Date of the lease was signed, I end that lease with effect from Leaving and key return date, a date that respects the minimum notice of thirty days.

Keep this clause or the next one, not both. Use this one to leave in the middle of a lease year, after the first 6 months.

    2. 2.2

      Optional

By this letter I notify you, under articles 9.1 and 10.1 of Ley 29/1994 on Urban Leases, that I do not wish to renew the lease dated Date of the lease at its expiry or at the expiry of the current renewal, on Leaving and key return date, in compliance with the legal notice period.

For the end of the term or of a yearly renewal. Notice: 30 days in the first 5 or 7 years, 2 months when the minimum term ends, 1 month in a later tacit year.

  3. 3.Key handover and condition of the home

From that date my address will be Tenant's address after leaving.

  5. 5.Signature

Formalities

  1. Send the notice in a form that proves the content and the date of receipt.
  2. Provable forms: burofax with certificate of text and acknowledgement of receipt, a notarial notice, or the email address the lease designates for notices.
  3. To be safe, count the notice period from the day the landlord receives it, not from the day you send it.
  4. Every co-tenant who leaves should sign.
  5. Keep a copy.
  6. No reason is needed.

Common mistakes

  • Leaving before 6 months. The early exit right does not exist yet, so leaving is a breach and the landlord can claim damages.
  • Sending the notice at the last moment. Post and burofax take days, so send it early enough that the landlord receives it before the period starts.
  • Using WhatsApp or a plain email that the lease does not designate. If the landlord denies receipt, you cannot prove the date.
  • Mixing up early exit and non-renewal. At the end of a lease year in the first 5 or 7 years, non-renewal needs 30 days and no early-exit compensation applies.
  • Handing back the keys without a signed exit report. Ask for a joint inspection and sign the end-of-lease document.
  • Not giving a bank account for the deposit. Name the IBAN in the notice so that the landlord has no reason to delay.

Legal basis

  • Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos, art. 9 (minimum term and yearly renewals)
  • Ley 29/1994, art. 10 (extension after the minimum term)
  • Ley 29/1994, art. 11 (tenant's early exit), as worded by RDL 29/2026
  • Ley 29/1994, art. 4.6 (notices by email)
  • Ley 29/1994, art. 36.4 (interest on a late deposit return)
