Move-in inventory report template for Spain

Move-in and move-out condition report and inventory · Acta de estado e inventario de la vivienda (entrada y salida)

A room-by-room record of the home's condition, the furniture, the meter readings and the keys, signed by landlord and tenant when the tenant moves in and again at move-out. At move-out it serves as the end-of-lease document that RDL 29/2026 requires.

Use it on the day the keys are handed over, as an annex to the lease, and again on the day they are returned. Use the same form both times so that the two records compare line by line. It is the main evidence when the landlord wants to keep part of the deposit for damage.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • The end-of-lease document and its presumption (LAU art. 36.7) come from RDL 29/2026, in force since 8 October 2026 and awaiting a vote of the Diputación Permanente.
  • If the decree-law is rejected, the duty ends for the future. A signed exit report is still the best evidence.

Formalities

  1. Both parties, or their representatives, inspect the home together and sign each page.
  2. Make one copy per party.
  3. Take dated photos or a video and refer to them in the report.
  4. No notary or registration is needed.
  5. If the parties disagree, each can write a reservation in the observations section before signing.
  6. Since 8 October 2026, RDL 29/2026 requires a signed end-of-lease document at move-out. The exit part of this form meets that duty.

Common mistakes

  • Writing "en buen estado" for every room. Describe each wall, floor, door, window and appliance, and note every mark, crack or stain.
  • Leaving out photos. Dated photos or a video referred to in the report settle most disputes over the deposit.
  • Forgetting the meter readings. Without them, utility bills between the two dates are hard to divide.
  • Signing the exit report without listing the damage the landlord claims. If the document notes no damage, the home is presumed returned in good condition.
  • Charging the tenant for normal wear. Faded paint or worn floors after years of use are the landlord's cost.
  • Keeping the whole deposit without a breakdown. List each deduction with its cost so that the tenant can check it.

Legal basis

  • Código Civil, arts. 1561 and 1562 (return of the property and presumption of good condition)
  • Código Civil, arts. 1563 and 1564 (tenant's liability for damage)
  • Ley 29/1994, de Arrendamientos Urbanos, art. 21 (repairs)
  • Ley 29/1994, art. 36.4 and 36.7 (deposit return and end-of-lease document)
  • Real Decreto-ley 29/2026, de 6 de octubre, art. 3.Dieciocho (adds LAU art. 36.7)
