Buyer's due diligence checklist for Norway

Checks before you bid on a home · Sjekkliste før bud og kjøp av bolig

The checks a buyer should complete before bidding on a used home in Norway: title and charges, the condition report and the seller's self-declaration, permits and plans, the energy certificate, condominium or cooperative documents, licensing, financing and total cost.

Use it before you bid. The sale binds you the moment the seller accepts your bid, so do every check first. Most documents are in the estate agent's sales prospectus. Ask the agent for anything missing. Get a building surveyor or a lawyer for a home with a poor condition report.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

The checklist

Seller, title and charges

  • Check the registered owner, mortgages and rights, such as rights of way, in the land registerGrunnboksutskrift

The seller must be the registered owner, or prove the right to sell, for example as an estate.

  • Confirm that the seller's spouse consents, if the home is the couple's shared homeEktefellesamtykke

A married owner cannot sell the shared home without the other spouse's written consent.

  • Ask about unregistered rights, leases and shared linesUtinglyste heftelser, bruksrett

Water, sewage and road rights, and existing tenants, are often not registered. The seller must disclose what it knows.

  • Check whether the plot is owned or leasedSelveiet eller festet tomt, festeavgift

On leased land you pay a yearly ground rent and the lease terms limit your rights. The agent must state the ownership form.

Condition of the building

  • Read the condition report in full and note every TG2 and TG3Tilstandsrapport, tilstandsgrad

You are treated as knowing what the report clearly states. The surveyor gives the usable area (BRA) under NS 3940:2023.

  • Check the report date, and that the surveyor applied the NS 3600:2025 criteria for condition gradesRapportens varighet

A report older than 1 year when you commit to buy lacks the effect the regulation gives it.

  • Read the seller's self-declaration and compare it with the reportSelgers egenerklæringsskjema

The seller is liable for facts it knew and did not disclose. If the two documents differ, ask questions before you bid.

  • Inspect the home yourself, ideally with a building surveyorVisning, besiktigelse

If you inspected, or ignored the seller's request to inspect, you cannot claim what you should have seen.

  • Get the energy certificateEnergiattest

The owner must have a valid energy certificate and include it in the marketing. It shows the energy rating and the list of measures.

Planning and permits

  • Check for a completion certificate or temporary use permitFerdigattest, midlertidig brukstillatelse

Missing approval of works or of rooms used as living space can lead to orders from the municipality. The agent must state it.

  • Read the zoning plan and any planned roads or building nearbyReguleringsplan, kommuneplan

The agent must state the property's relation to final public plans. Ask the municipality about plans still in progress.

  • Confirm whether a separate flat in the home may be letGodkjent utleiedel

The agent's prospectus must state whether the home or part of it may be let as housing. Rental income from an unapproved unit is at risk.

Condominium section or cooperative share

  • Get the condominium's rules, accounts, budget and minutesVedtekter, regnskap, årsmøteprotokoll

They show the common costs, planned works, special levies and limits on letting or pets.

  • Check that you will not own more than two residential sections in the same condominiumErvervsbegrensning

The cap counts close relatives and related companies. A close relative may still buy a section to live in. Holiday homes are exempt.

  • For a cooperative share, get the share of common debt, the monthly common costs and the cooperative's accountsFellesgjeld, felleskostnader

The common debt is part of your real price and of the total cost the agent must state (eiendomsmeglingsloven § 6-7 (2)).

  • Check board approval and pre-emption rights in the cooperativeStyregodkjenning, forkjøpsrett

You may not move in before the board approves you. A member can take over the purchase at your price within the legal deadline.

Money, licensing and registration

  • Get a written financing confirmation from your bankFinansieringsbevis

The agent must check your financing before the sale is agreed. Banks lend as a rule up to 90% of the value.

  • Add up the total costOmkostninger, dokumentavgift, tinglysingsgebyr

On a freehold home you pay 2.5% document duty on market value and NOK 545 per registered document on top of the price.

  • Find out whether you need a licence or a self-declaration of exemptionKonsesjon, egenerklæring om konsesjonsfrihet

Most home purchases need only a self-declaration, and some need none. Larger or agricultural properties may need a licence.

  • Make sure the municipality registers the licensing status

Kartverket registers your deed only after the municipality has registered the licensing status.

  • If you have no Norwegian ID number, prepare a D-number applicationD-nummer

Kartverket requests a D-number for a foreign buyer with the deed. Outside the Nordic countries, a notary must certify your passport copy.

Formalities

This kind is always a checklist.

  1. No step needs a notary.
  2. The estate agent must give you a written prospectus with a minimum list of facts before the sale is agreed.
  3. You can order a land register extract from Kartverket and planning information from the municipality yourself.
  4. For a housing cooperative share, the cooperative's board may have to approve you.
  5. The cooperative's members may have a pre-emption right.

Common mistakes

  • Doing your checks after the bid. The accepted bid is the binding sale, and there is no withdrawal right.
  • Skimming the condition report. A part rated TG2 or TG3 has a fault the report describes, and you cannot claim what the report clearly states as a defect later.
  • Looking only at the price of a cooperative flat. Your share of the common debt and the monthly common costs are part of what you pay.
  • Assuming a basement flat can be let. Ask whether it is approved for letting; the agent's prospectus must say so.
  • Ignoring missing completion certificates. Unapproved works can lead to orders from the municipality after you buy.
  • Forgetting the licensing step. Kartverket can return the deed if the municipality has not registered the licensing status.

Legal basis

  • Lov 29. juni 2007 nr. 73 om eiendomsmegling (eiendomsmeglingsloven) § 6-7 (information the agent must give the buyer before the sale)
  • Lov 3. juli 1992 nr. 93 om avhending av fast eigedom (avhendingslova) §§ 3-7 to 3-10 (seller's duty to inform, buyer's knowledge and inspection)
  • Forskrift 8. juni 2021 nr. 1850 til avhendingslova (tryggere bolighandel), as amended from 1 January 2026
  • Forskrift 18. desember 2009 nr. 1665 om energimerking av bygninger (energimerkeforskriften) §§ 4 and 5
  • Lov 6. juni 2003 nr. 39 om burettslag (burettslagslova) §§ 4-5 and 4-15 (board approval and pre-emption deadline)
  • Lov 16. juni 2017 nr. 65 om eierseksjoner (eierseksjonsloven) § 23
