Residential lease agreement template for Lithuania

Residential lease · Gyvenamosios patalpos nuomos sutartis

A written lease of a flat or house for the tenant to live in, under CK 6.576 to 6.616. It sets the parties, the home and its equipment, the term, rent and utilities, the deposit, duties, renewal and termination. Register it with Registrų centras so that it binds a new owner.

Use it when a private person or a company lets a flat or house, furnished or unfurnished, to a tenant who will live there. It covers a fixed-term and an open-ended lease. Do not use it for holiday stays, for business premises or for social housing. A room that shares its entrance with another room, or a kitchen or corridor alone, cannot be let under a separate lease (CK 6.581). Mandatory rules void some clauses whatever the parties sign, such as a landlord's right to change the terms alone, or penalties above the landlord's real loss (CK 6.580(4) and 6.587).

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

  3. 3.Term

    1. 3.1

      Optional

The lease is made for a fixed term: from Start date to End date of a fixed-term lease.

Keep this clause or the open-ended one below, not both. In a fixed-term lease the landlord cannot end the lease early without a court.

    2. 3.2

      Optional

The lease is made for an indefinite term, starting on Start date.

In an open-ended lease the landlord can end it with 6 months' written notice (CK 6.614(1)).

  4. 4.Handover of the Premises

    1. 4.1

The Premises, with the furniture and equipment in them, are handed over to the Tenant on Start date, when the Parties sign a handover-acceptance act that records the condition of the Premises, the list of furniture and equipment, the meter readings and the number of keys handed over. The act is an integral part of the lease.

A clause that lets the landlord alone assess the condition and declare the home fit to live in is void (CK 6.580(4)). Both parties sign the act.

    2. 4.2

The Landlord hands over to the Tenant vacant premises fit to live in. The Landlord is not liable only for those defects of the Premises recorded in the handover-acceptance act.

      CK 6.587(1) and 6.483(2).

  5. 5.Rent

    1. 5.1

The rent is Monthly rent EUR per month. The Tenant pays it for the current month by day Payment day of each month of each month to the Landlord's account Landlord's bank account (IBAN).

Without an agreed date, rent is due by the 20th of the following month (CK 6.583(2)).

    2. 5.2

The Tenant pays in advance only the rent for the first month of the lease.

The landlord cannot demand more rent in advance (CK 6.583(5)).

    3. 5.3

The rent may be revised only by written agreement of the Parties, no earlier than twelve months after the lease is made and no more than once a year.

A clause that lets the landlord revise the rent alone is void (CK 6.583(6)). At renewal the landlord can propose a new rent with the notice in CK 6.607(4).

  6. 6.Utilities and other costs

    1. 6.1

The Tenant pays for the following services: Utilities the tenant pays and how. Charges are calculated from the meter readings recorded in the handover-acceptance act and from the suppliers' invoices.

In a commercial let the parties decide who pays which utilities (CK 6.584(3)). Give the tenant copies of the invoices you pass on.

    2. 6.2

The Landlord pays: Costs the landlord keeps.

  7. 7.Deposit

    1. 7.1

On signing the lease, the Tenant pays the Landlord a deposit of Deposit EUR, which secures the performance of the Tenant's obligations under this lease. The deposit is not rent and cannot be set off against the last month's rent without the Landlord's consent. No interest is paid on the deposit.

The law sets no deposit cap. Courts treat it as a security agreed by the parties (CK 6.70), so the amount is a matter of agreement.

    2. 7.2

The Landlord returns the deposit within Days to return deposit after key return days of the return of the Premises, deducting only unpaid rent, unpaid utility bills and documented losses from damage to the Premises or property beyond normal wear. The Landlord states any deductions in writing.

Since the law sets no deadline, write one here. Without it, the tenant can only rely on a reasonable time.

  8. 8.Landlord's rights and duties

    1. 8.1

The Landlord carries out major repairs of the Premises at the Landlord's expense, ensures repairs of the common property of the building and of the utility equipment, and remedies defects not caused by the Tenant.

      CK 6.492(1) and 6.587(6).

    2. 8.2

When the lease is made, the Landlord gives the Tenant a copy of the owners' association statute or of another document setting the rules for the use and upkeep of the common parts.

Required by CK 6.580(3). The copy is part of the lease.

    3. 8.3

The Landlord may enter the Premises only at a time agreed in advance with the Tenant, except in an emergency.

  9. 9.Tenant's rights and duties

    1. 9.1

The Tenant uses the Premises only as a home, pays the rent and service charges on time, follows the house rules, takes care of the Premises and carries out routine repairs at the Tenant's expense.

Routine repairs fall on the tenant unless the lease says otherwise (CK 6.493(1)).

    2. 9.2

The Tenant informs the Landlord without delay of emergencies and of defects that need urgent repair.

      CK 6.493(2).

    3. 9.3

Without the Landlord's written consent, the Tenant may not sublet the Premises, alter their layout or change their equipment. The Tenant informs the Landlord in advance of any plan to let other persons stay temporarily.

Subletting needs the landlord's written consent (CK 6.595(1)). Temporary residents need prior notice to the landlord (CK 6.596(1)).

    4. 9.4

      Optional

Rules on keeping pets and smoking in the Premises: Rules on pets and smoking.

  10. 10.Renewal

    1. 10.1

      Optional

A Tenant who has kept to the lease has a priority right to a lease for a new term. No later than three months before the end of the term, the Landlord informs the Tenant in writing of an offer to make a new lease and its terms, or of a refusal to renew if the Landlord does not plan to let the Premises for at least one year.

Keep it for a fixed-term lease. A refusal followed by a new letting on the same terms within a year exposes the landlord to damages (CK 6.607(3)).

  11. 11.Termination

    1. 11.1

The Tenant may end the lease at any time by giving the Landlord one month's written notice. Until the notice period ends, the Tenant may withdraw the notice if the Landlord has not yet let the Premises to another tenant.

CK 6.609(1) and (2). A clause that demands a fee above the landlord's real loss for leaving is void (CK 6.587(5)).

    2. 11.2

      Optional

The Landlord may end an open-ended lease by giving the Tenant six months' written notice.

CK 6.614(1). Delete it in a fixed-term lease.

    3. 11.3

If the Tenant fails for at least three months to pay the rent or the utility charges, damages the Premises, uses them for another purpose, or by improper conduct makes it impossible for others to live there, the Landlord, after a written warning that sets a reasonable time to remedy the breach, may ask a court to end the lease and evict the Tenant.

A residential lease ends against the tenant's will, and an eviction happens, only through a court (CK 6.610, 6.611).

  12. 12.Return of the Premises

    1. 12.1

When the lease ends, the Tenant returns the Premises, the furniture, the equipment and the keys in the condition received, allowing for normal wear. The Parties sign a return act that records the condition of the Premises and the meter readings.

      CK 6.499(1).

    2. 12.2

If the Tenant returns the Premises late, the Tenant pays rent for the whole period of delay and compensates the Landlord's losses.

      CK 6.499(2).

  13. 13.Registration

    1. 13.1

      Optional

The Parties agree to register the lease in the Real Property Register. Who registers the lease and pays the fee undertakes to register the lease and pay the registration costs.

Strongly advised for the tenant. Without registration the lease does not bind a buyer of the home (CK 6.579(4), 6.585).

  14. 14.Final provisions

    1. 14.1

Amendments to the lease are valid if made in writing and signed by both Parties. Notices are sent to the following addresses and email addresses: Addresses and emails for notices.

A written lease that is changed is replaced by a new written lease that sets out the changes (CK 6.598(3)).

    2. 14.2

Annexes to the lease: the handover-acceptance act with the list of furniture and equipment; a copy of the owners' association statute or house rules; a copy of the energy performance certificate.

    3. 14.3

The lease is governed by the law of the Republic of Lithuania. Disputes are settled by negotiation or, failing agreement, by the courts of the Republic of Lithuania.

  15. 15.Signatures

    1. 15.1

The lease was made at Place of signature, on Date of signature, in two originals of equal legal force, one for each Party. Landlord: (name, surname, signature). Tenant: (name, surname, signature).

Formalities

  1. A fixed-term lease must be in writing (CK 6.579(3)). An open-ended lease between private persons can be oral, but only a written lease is safe.
  2. Both parties sign, one original each. No notary is needed. Sign a handover-acceptance act on the day the keys pass.
  3. At signing, the landlord gives the tenant a copy of the owners' association statute or other rules on the common parts (CK 6.580(3)).
  4. At signing, the landlord also gives a valid energy performance certificate or its copy (Statybos įstatymas, art. 51(3), point 3).
  5. Register the lease in the Real Property Register to bind a buyer and other third parties (CK 6.579(4)). Fee EUR 8.19, done within 5 working days.
  6. Apply to Registrų centras in its self-service, by email or e-delivery, at a customer office, or through a notary.
  7. To register, the lease states its date, the parties' names and personal codes, the property's unique number, the subject and the rent.
  8. If a notary's enforcement record is registered for the property, the creditor, usually a bank, must consent to registration.

Common mistakes

  • Not registering the lease. A buyer of the home, or a bank that enforces a mortgage, is then not bound by it.
  • Asking for several months' rent in advance. Only the first month can be demanded in advance. Call the deposit a deposit and say what it secures.
  • Writing that the landlord may raise the rent alone, or more than once a year. Such a clause is void.
  • Adding penalties above the landlord's real loss, or a right to claim rent for the whole term after one late payment. Both are void (CK 6.587(5)).
  • Changing the locks or cutting utilities to remove a tenant. Only a court can end the lease against the tenant's will and order an eviction (CK 6.610).
  • Skipping the handover-acceptance act. The tenant returns the home as received, less normal wear (CK 6.499(1)). Without a signed record, that is hard to prove.
  • Forgetting the renewal deadline. Unless the landlord writes at least 3 months before a fixed term ends, or the tenant refuses, the lease renews (CK 6.607(2)).
