Lease termination letter template for Lithuania

Tenant's notice to end a residential lease · Įspėjimas apie gyvenamosios patalpos nuomos sutarties nutraukimą

The tenant's written notice that ends a residential lease. Under CK 6.609 the tenant can end a fixed-term or open-ended lease at any time by warning the landlord in writing 1 month ahead. No reason is needed. Count the month from the day the landlord receives the notice.

Use it when you rent a home in Lithuania and want to leave, whether the lease is for a fixed term or open-ended. Send it at least 1 month before the date you plan to return the keys. If you leave without notice, the landlord can claim the loss this causes (CK 6.609(1)). The landlord's own notice follows other rules: 6 months in writing for an open-ended lease (CK 6.614), and for a fixed-term lease only a court can end it early, for a serious breach (CK 6.610, 6.611).

Formalities

  1. The notice must be in writing (CK 6.609(1)).
  2. Send it to the notice address or email in the lease, by registered mail or email, or hand it over against the landlord's signed, dated receipt.
  3. Keep proof of the date the landlord received it. Count the month from that date.
  4. Each tenant who signed the lease signs the notice.

Common mistakes

  • Giving notice only by phone. The Civil Code requires a written notice. Send a letter or an email to the notice address in the lease.
  • Counting the month from the day you send the notice. Count it from the day the landlord receives it, which you can prove.
  • Stopping rent payments at once. Rent stays due until the notice period ends and the keys are returned.
  • Using the deposit as the last month's rent without the landlord's written agreement. The deposit is a security, not rent.
  • Returning the keys without a signed return act and meter readings. Without them it is hard to show the condition of the home when you left.
  • Forgetting to give an account for the deposit return. State it in the notice.

Legal basis

  • Lietuvos Respublikos civilinis kodeksas (Civil Code), Law No VIII-1864 of 18 July 2000, art. 6.609 (tenant's right to end the lease)
  • Civil Code, art. 6.610, 6.611 and 6.614 (termination by court; landlord's notice for an open-ended lease)
  • Civil Code, art. 6.499 (return of the home) and 6.587(5) (void penalty clauses)
