Move-in inventory report template for Lithuania

Handover-acceptance act for a let home (move-in and move-out) · Gyvenamosios patalpos perdavimo–priėmimo aktas

The record that landlord and tenant sign when the keys pass at the start of a lease and when they come back at the end. It describes each room, the furniture and equipment, the meter readings and the keys. Comparing the two records decides what the landlord may deduct from the deposit.

Sign it on the day the tenant receives the keys, and again on the day the tenant returns them. Use the same layout both times so the two states can be compared. Attach it to the lease as an annex. Lithuanian law sets no official form, but the Civil Code ties the landlord's liability for defects and the tenant's duty on return to the condition at handover, and this act is the usual proof of that condition.

Formalities

  1. No official form, notary or registration applies.
  2. Landlord and tenant inspect the home together and both sign the act. Make two originals, one each.
  3. Take dated photos of each room and each meter, and list them in the act.
  4. A clause that lets the landlord alone assess the home's condition and declare it fit to live in is void (CK 6.580(4)).
  5. The tenant signs only what matches the home and notes any disagreement in the act.

Common mistakes

  • Signing a blank or general form such as "būklė gera" for every room. Describe each wall, floor, window and appliance, and note every mark.
  • Not reading the meters on the day. Write down each reading and photograph it, or the tenant may pay for the previous occupant's use.
  • Leaving out the furniture list. Without it, the landlord cannot prove that an item was there, and the tenant cannot prove that it was already broken.
  • Not recording how many keys and fobs were handed over. A missing key at the end leads to a deduction.
  • Deducting normal wear from the deposit. Faded paint and small marks from ordinary living are normal wear, not damage.
  • Doing the exit inspection without the tenant. Fix a date together and sign the return act jointly.

Legal basis

  • Lietuvos Respublikos civilinis kodeksas (Civil Code), Law No VIII-1864 of 18 July 2000, art. 6.483 (handover of the leased thing)
  • Civil Code, art. 6.499 and 6.500 (return of the leased thing; tenant's liability for deterioration)
  • Civil Code, art. 6.580 (content of a residential lease; void clauses) and 6.587 (landlord's duties)
