Residential lease agreement template for Latvia

Residential lease · Dzīvojamās telpas īres līgums

A fixed-term lease of a flat or house for living in, under the Residential Tenancy Law of 2021. It contains the five terms the law requires (premises, term, rent and how it changes, services, occupants), the deposit, termination grounds, and optional eviction and Land Register clauses.

Use it when a private owner lets a flat, a house or a separate room to live in. Do not use it for a short holiday or tourist let, which the act excludes, or for municipal housing. The act sets minimum protections, and the Civil Law applies where it is silent.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • Unregistered leases signed before 1 May 2021 bind a new owner only until 31 December 2026. A registration claim filed in time extends this to the court decision.
  • The amendment in force from 1 July 2026 changes only point 6 of the transitional provisions, on municipal leases. It does not change the 31 December 2026 deadline.

Formalities

  1. The lease must be in writing, on paper or with a secure electronic signature. Make one copy for each party.
  2. No state form and no registration are mandatory.
  3. Registering the lease in the Land Register makes it binding on a future buyer. Registration is free of the office fee.
  4. To register, each party signs the corroboration request with a secure electronic signature, or a notary or the court certifies the signature.
  5. In a notarial deed or a registered lease, the parties can add an eviction clause. A court enforces it in an undisputed procedure.
  6. A handover and acceptance report at the start and at the end is optional but strongly advised.

Common mistakes

  • Asking for a deposit above 2 months' rent. The act caps it at 2 months.
  • Leaving out a rent review clause. Without one, the landlord cannot raise the rent during the lease, only by written agreement.
  • Writing a lease with no end date. The act requires a fixed term.
  • Expecting an unregistered lease to survive a sale. It ends when the buyer is registered, and the buyer can ask the tenant to leave within 2 months.
  • Letting people move in who are not named. The tenant may move in a spouse and children after written notice to the landlord.
  • Letting anyone else move in without the landlord's written consent. Unauthorised occupants are a ground to end the lease.
  • Refusing to let the tenant declare residence at the address. The act forbids it.
  • Cutting utilities or changing the locks to force a tenant out. It is an administrative offence, and only a court can order eviction.
