Residential lease agreement template for Italy

Residential lease at free rent (4 + 4 years) · Contratto di locazione ad uso abitativo a canone libero (art. 2, comma 1, legge 9 dicembre 1998, n. 431)

The standard Italian lease for a main home at a rent the parties set freely. It runs for 4 years and renews for 4 more unless the landlord has a reason listed in the law. It covers rent, rent updates or the flat-tax option, deposit, charges, registration, early exit and handover.

Use it when an individual lets a home, furnished or not, to a tenant for long-term residential use and the parties want to set the rent freely. Do not use it for holiday lets, for a temporary need of up to 18 months, for university students, or for an agreed-rent lease with tax benefits: those have their own official models. Legge 431/1998 does not apply to homes in cadastral categories A/1, A/8 and A/9 or to listed buildings, which follow the Civil Code.

Rules that are changing

  • Bill A.S. 1896 on the recovery of property, approved by the Council of Ministers on 30 April 2026, is before the Senate Justice Committee. It is not law yet.
  • As proposed, A.S. 1896 would speed up eviction at lease end, cut the court's grace period to pay arrears from 90 to 45 days, and add a daily penalty of 1% of the monthly rent for late departure.
  • From 1 January 2027 the lease registration tax rules move from DPR n. 131/1986 into the Testo unico dell'imposta di registro (d.lgs. 1 agosto 2025, n. 123). Check them when you register, renew or end.
Official model: Contratto tipo di locazione abitativa agevolata (Allegato A al D.M. 16 gennaio 2017)

Mandatory only for agreed-rent leases (canone concordato, 3 + 2 years), with the rent bands of the local agreement. Allegati B and C are the models for transitional and student leases. A free-rent lease has no official model.

Formalities

  1. Make the lease in writing, or it is void. Both parties sign each original.
  2. Every party needs an Italian tax code (codice fiscale). This includes a foreign tenant.
  3. The landlord registers the lease with the Agenzia delle Entrate within 30 days of signature, or of the start date if earlier. Online, use the RLI service.
  4. Within the next 60 days, the landlord gives documented notice of the registration to the tenant and to the condominium administrator.
  5. Stamp duty is 16 euro per 4 pages or 100 lines, unless the landlord chooses the flat tax.
  6. The lease must state that the tenant received the energy certificate (APE) and information. For a single flat, no copy need be attached.
  7. For a non-EU tenant, the landlord notifies the police (autorità di pubblica sicurezza) in writing within 48 hours of handing over the home.

Common mistakes

  • Not registering the lease. A court can then set the rent at the tenant's request, up to the minimum of the local agreed-rent bands (legge 431/1998, art. 13).
  • Writing a term shorter than 4 years in a free-rent lease. Any clause that cuts the legal duration is void, and the lease runs for 4 + 4 years anyway.
  • Asking for a deposit above 3 months' rent, or treating the deposit as the last months' rent.
  • Choosing the flat tax and keeping a rent update clause. Under cedolare secca the landlord cannot ask for any increase, ISTAT included, while the option lasts.
  • Using this lease for a temporary need. A transitional lease of up to 18 months needs the official model and proof of the need, or it becomes a 4 + 4 lease.
  • Skipping the move-in report. Without a description, the tenant is presumed to have received the home in good repair.
  • Refusing renewal for a stated use and not starting it within 12 months. The tenant can claim reinstatement or damages of at least 36 months of the last rent.
  • Forgetting the police notice for a non-EU tenant. Lease registration does not replace it. The fine is 500 to 3,500 euro (d.lgs. 286/1998, art. 7, comma 2-bis).
