Residential lease agreement template for Iceland

Residential lease · Húsaleigusamningur um íbúðarhúsnæði

A lease for a home under húsaleigulög nr. 36/1994, in the structure of the HMS standard lease. It sets the parties, the home, the term, the rent and how it may change, the operating costs, the security, the inspection and fire safety, and the landlord's duty to register the lease in the HMS rental register.

Use it to let a flat or a house as a home, open-ended or for a fixed term. For a single room, keep the same structure and describe the room and the shared facilities. Do not use it for business premises. The act is mandatory for homes: a term that gives the tenant fewer rights or more duties than the act has no effect. HMS publishes the official form in Icelandic and English, and the island.is digital lease registers itself in the rental register when all parties sign.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • From 1 January 2027, HMS can fine private landlords who do not register, change or deregister a lease in Leiguskrá. Until then only landlords who let homes as a business can be fined.
  • Bill þingskjal 158 (3 October 2026) would ban monthly index-linking of rent and require 12 months between periodic rent changes. Check whether it passed.
  • The bill would bar combined periodic increases and cap any periodic increase at the consumer price index.
  • The new rule would apply from 1 July 2028. Parties may agree to apply it to leases made before the act takes effect.
Official model: Húsaleigusamningur um íbúðarhúsnæði (HMS standard form)

HMS also publishes an English version and a digital lease on island.is that registers itself in Leiguskrá. The footer of the PDF form still says only commercial landlords must register. Since 1 January 2026 every landlord must.

Formalities

  1. The lease is in writing. Signatures may be handwritten or electronic. Each party keeps one signed copy.
  2. The landlord registers the lease in the HMS rental register (Leiguskrá) within 30 days of signing.
  3. The landlord registers rent changes within 30 days and deregisters the lease within 30 days of its end. An unregistered rent increase does not bind the tenant.
  4. If the landlord has not registered the lease at handover, the tenant may register it.
  5. HMS registers a hand-signed paper lease in Leiguskrá only if two witnesses signed it.
  6. Both parties inspect the home, including fire safety, when the lease is made and at its end, and record the results in the lease.
  7. Registering the lease in the land register (þinglýsing) is optional. It needs two witnesses and a copy on approved paper.
  8. No stamp duty applies.

Common mistakes

  • Not registering in Leiguskrá. An unregistered rent increase does not bind the tenant. Tax relief on rent needs a registered lease, for up to two homes.
  • A deposit above 3 months' rent, or not kept in a separate account. Use it for damage only with consent or a final ruling.
  • Writing an index-linked rent into a fixed-term lease that changes in the first 12 months. The law forbids it for leases made from 1 January 2026.
  • Ending an open-ended lease without a lawful ground or without the HMS form. The tenant can take the notice to the Housing Complaints Committee.
  • Calling the lease fixed-term without a clear end date. A lease is open-ended unless a fixed term is clearly agreed.
  • Skipping the joint inspection at the start. Without a record of the condition, a deposit dispute at the end is hard to win.
  • Charging the tenant a letting fee for arranging the lease. The law bars it, except a fair fee for a special service.
  • Letting a married owner's family home without the spouse's written consent.

Legal basis

  • Húsaleigulög nr. 36/1994, as amended by lög nr. 106/2024, nr. 72/2025 and nr. 11/2026
  • Lög nr. 72/2025 um breytingu á húsaleigulögum (general registration duty and rent changes in fixed-term leases), in force 1 January 2026, 3. gr. (transition and fines) and 4. gr. (tax relief)
  • Hjúskaparlög nr. 31/1993, 60. gr. (spouse's consent to let the family home)
