Residential lease agreement template for France

Unfurnished residential lease (main home) · Contrat de location de logement nu (bail d'habitation, résidence principale)

The lease for an unfurnished home that is the tenant's main residence, in the structure of the official model of décret n° 2015-587 as updated from 1 October 2026. It sets the parties, the home, the duration, rent and charges, deposit, termination clause, agency fees and the mandatory annexes.

Use it when an individual or a company lets an unfurnished home that the tenant will occupy as a main residence, alone or as co-tenants under one lease. Do not use it for a furnished let (meublé), a holiday let, a student residence or social housing under an agreement. Loi n° 89-462 is mandatory law: a clause that departs from it in the tenant's disfavour has no effect.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Formalities

  1. The lease must be in writing and follow the official model.
  2. Make one original per party, each signed. Electronic signature is allowed.
  3. Attach the diagnostics file: energy certificate, lead report for buildings from before 1949, asbestos information, gas and electricity reports.
  4. The diagnostics file also includes the risk report where it applies. The landlord must give the risk report at the first visit.
  5. Also attach the official information notice on tenants' and landlords' rights, and the entry inventory.
  6. For a flat, attach the extracts of the copropriété rules on use and charges. Attach any local prior letting authorisation.
  7. No registration or stamp duty applies. Write "néant" or "sans objet" in any field that does not apply.
  8. In zones tendues an annual decree caps the rent at reletting. Check the commune with the Service-Public.fr simulator before you set the rent.

Common mistakes

  • Letting a home rated G. Since 1 January 2025 it is not decent for a lease signed, renewed or tacitly renewed from that date. The tenant can demand works.
  • Asking for a deposit above 1 month's rent excluding charges, or asking for any deposit when the rent is payable more than 2 months in advance.
  • Setting the rent without checking the commune. In a zone tendue the rent at reletting is capped.
  • Exceeding the capped reference rent in a city with reference rents. Only a justified rent supplement allows it.
  • Adding clauses that loi 89-462, art. 4 voids, such as fixed penalties for late rent or forcing payment by direct debit. They have no effect.
  • Using this unfurnished model for a furnished home. A furnished lease has its own model, a 1-year term, a 2-month deposit cap and a mandatory furniture list.
  • Leaving out the annexes. A missing energy certificate or information notice weakens the landlord's position in a dispute.
  • Forgetting the entry inventory. Without one, the tenant is presumed to have received the home in good repair, unless the landlord blocked the inventory.
