Residential lease agreement template for Estonia

Residential lease · Eluruumi üürileping

A lease of a flat or a house for permanent living under the Law of Obligations Act. It sets the parties, the home, the term, the rent, the utilities, the deposit, the use and repair duties, the ending of the lease and the return of the home. The state publishes no official model.

Use it when a private or business landlord lets a flat or a house, furnished or not, for the tenant to live in. Do not use it for a holiday or hotel let of up to 3 months, for a room in the landlord's own home that the landlord largely furnished, or for a home that the state or a municipality lets to people in urgent need of housing or to students: the residential lease rules do not apply to those (Võlaõigusseadus § 272(4)). A clause that departs from the law to the tenant's disadvantage is void (§ 275).

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • Bill 1062 SE, initiated in the Riigikogu on 19 October 2026, would let a landlord end the lease for late payment once arrears reach one month's rent or one month of other agreed costs.
  • The tenant would get 30 days to pay instead of 14. The court or the rent committee would set the date to vacate the home in its decision.
  • The planned start date is 1 October 2027. The Riigikogu has not adopted it.

Formalities

  1. No witness, notary or registration is needed. Sign on paper or with an Estonian digital signature, one copy for each party.
  2. Before signing, check in the land register that the landlord owns the home or holds the owner's consent to let it.
  3. A lease for more than one year that is not in writing counts as open-ended. It cannot end before one year from handover (§ 274).
  4. Agreements on utilities, building upkeep costs, a contractual penalty, a higher late interest rate and return in renovated condition need a written form.
  5. That form is one that can be reproduced in writing, so keep those agreements in the signed lease.
  6. Attach the handover report with photos, meter readings and the list of keys and furniture.
  7. The landlord must let the tenant see the energy performance certificate and give a copy at signing, or have it in the building register (Ehitusseadustik § 67).
  8. A tenant can ask for a note of the lease in the land register (§ 324). The note protects the lease if the property is sold.

Common mistakes

  • Asking for a deposit above 3 months' rent, or refusing payment in three parts. The tenant can refuse to pay the excess.
  • Keeping the deposit on the landlord's own account. The law requires a separate deposit in a credit institution, with interest for the tenant.
  • Writing that the tenant pays all costs of the owner. Utilities are owed only as agreed in writing and only for costs linked to the use of the home.
  • Agreeing a penalty for late rent. A penalty for a monetary breach is void. Use late interest instead, within the legal cap.
  • Signing a fixed-term lease and expecting to end it early. Neither party can end it before the term without a serious reason.
  • Letting the tenant stay on after the term. If neither party objects within two weeks, the lease becomes open-ended (§ 310(1)).
  • Skipping the handover report. Without it, the landlord has a hard time proving damage at the end.
  • Giving notice by phone. A notice that is not in a form that can be reproduced in writing, or a landlord's notice without the required content, is void.
