Lease termination letter template for Estonia

Tenant's notice to end a residential lease · Eluruumi üürilepingu ülesütlemise avaldus (üürnik)

The tenant's written notice that ends a residential lease: by ordinary notice of at least 3 months for an open-ended lease, or by extraordinary notice on a ground set by law. It also asks for the handover date and the return of the deposit.

Use it when you rent a home and want to leave. For an open-ended lease, give at least 3 months' notice, or the longer period the lease sets. A fixed-term lease cannot be ended early by ordinary notice: use the extraordinary option only when a legal ground exists, or agree an early end with the landlord in writing.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • Bill 1062 SE, initiated in the Riigikogu on 19 October 2026, would let a landlord end a lease for late payment once arrears reach one month's rent.
  • The landlord would first give the tenant 30 days to pay instead of 14. The planned start date is 1 October 2027.
  • The bill does not change the tenant's own notice periods. The Riigikogu has not adopted it.

Tenant's notice to end a residential lease

  1. 1.Sender and recipient

    1. 1.1

Tenant: Tenant or tenants, contact details: Tenant's email and phone.

Give each tenant's full name and personal identification code or date of birth.

    2. 1.2

Landlord: Landlord's name, Landlord's email or postal address.

Send the notice to the address or email the lease names for notices.

  2. 2.Termination of the lease

    1. 2.1

I terminate the residential lease dated Date of the lease concerning the home at Address of the home.

    2. 2.2

      Optional

The termination is ordinary. Under § 312(1) of the Law of Obligations Act, the contract ends when the three-month notice period expires, that is on Day the lease ends.

Keep this clause or the next one, not both. Use this one for an open-ended lease. If the lease sets a longer period, count that period instead.

    3. 2.3

      Optional

The termination is extraordinary on the following ground: Legal ground and facts. The contract ends on Day the lease ends.

Use it for a fixed-term lease or a shorter period. Name the law and the facts, such as heating not fixed by your deadline (§ 314). Keep a copy of the deadline.

  3. 3.Return of the home and the deposit

    1. 3.1

I propose to inspect the home and draw up the handover report on Proposed move-out walk-through. I will return the home with all keys no later than the day the contract ends.

The landlord must inspect the home at return and report your defects without delay.

    2. 3.2

Please return the deposit with interest, less any justified claims, to my bank account Tenant's IBAN for the deposit. My new postal address is Tenant's new postal address.

If the landlord notifies no claim within 2 months after the lease ends, you can claim the deposit back (§ 308(3)).

  4. 4.Consent of the spouse or registered partner

    1. 4.1

      Optional

I, Consenting spouse or registered partner, who live with the tenant in the rented home, consent to the termination of the lease. Signature.

Required when the tenant's spouse or registered partner lives in the home (§ 325(3)). Delete it otherwise. A digital signature on the same file is enough.

  5. 5.Signature

    1. 5.1

Date: Date of the notice. Signature of the tenant.

If several tenants signed the lease, each should sign the notice.

Formalities

  1. The notice must be in a form that can be reproduced in writing (Võlaõigusseadus § 325(1)). An email, a digitally signed file or a signed letter is enough.
  2. Keep proof of the date the landlord received it. The notice period runs from receipt.
  3. If you live in the home with your spouse or registered partner, that person must consent in the same form, or the notice is void (§ 325(3) and (5)).
  4. If you use a period shorter than the legal one, the lease ends only when the correct period expires (§ 311(2)).

Common mistakes

  • Giving notice by phone or text without keeping a copy. Use email or a signed letter and keep proof of receipt.
  • Leaving out the consent of the spouse or registered partner who lives with you. The notice is then void.
  • Trying to end a fixed-term lease early by ordinary notice. It has no effect. Ask the landlord for a written agreement to end it, or rely on a legal ground.
  • Counting the 3 months from the date you send the notice. The period runs from the day the landlord receives it.
  • Stopping the rent to use up the deposit. The deposit secures the landlord's claims after the end, and arrears let the landlord end the lease and claim interest.
  • Leaving without a move-out report. Without it, it is hard to prove the condition in which you returned the home.

Legal basis

  • Võlaõigusseadus (Law of Obligations Act), §§ 309 to 314 and 317 (duration, ordinary and extraordinary termination)
  • Võlaõigusseadus, § 284(3) and § 303¹ (tenant's termination after notice of works or of a rent increase)
  • Võlaõigusseadus, § 325 (form and content of the notice, spouse's consent) and §§ 326 to 329 (contest of a landlord's notice)
  • Võlaõigusseadus, § 308 (deposit) and § 334 (return of the home)
