Lease termination letter template for Croatia

Tenant's notice to end a residential lease · Otkaz ugovora o najmu stana

The tenant's written notice that ends a residential lease. Under an open-ended lease the tenant gives at least 3 months' notice. Under a fixed-term lease the tenant gives written notice at least 30 days before the term ends, so the lease does not renew itself.

Use it when you rent a flat as your home and want to leave. You need no reason. Choose the clause that matches your lease: open-ended, end of a fixed term, or early exit if your lease allows it. The landlord's notice follows different rules: only on grounds in the Act, mostly breach after a written warning, with 3 months to vacate.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Rules that are changing

  • The draft new Residential Lease Act (not adopted) would let the tenant end any lease on 60 days' notice, without giving a reason.
  • The draft would lengthen the landlord's notice where the tenant is not at fault to 6 months, or 1 year after 5 years of lease.

Formalities

  1. Give the notice in writing and sign it by hand.
  2. Send it by registered mail with return receipt (preporučeno s povratnicom). Email alone is hard to prove.
  3. Or hand it to the landlord and ask for a signed and dated receipt on your copy.
  4. The notice period counts from the day the landlord receives the notice.
  5. If both spouses are tenants, both sign.
  6. Keep a copy and the postal receipt.

Common mistakes

  • Giving notice by phone or text message. The law requires writing, and you must be able to prove the date of receipt.
  • Counting the period from the day you post the letter. It runs from the day the landlord receives it.
  • Leaving a fixed-term lease early when it has no early-exit clause. Without the landlord's written agreement you owe rent until the term ends.
  • Sending the non-renewal notice for a fixed-term lease less than 30 days before the end. The lease then renews for the same term.
  • Leaving without a handback record. Agree a date, walk through the flat with the landlord and sign the record.
  • Stopping rent to recover the deposit. The deposit and the rent are separate, and unpaid rent is a ground for the landlord to claim.

Legal basis

  • Zakon o najmu stanova (NN 91/96, 48/98, 66/98, 22/06, 68/18, 105/20, 36/24), art. 23 (tenant's notice), art. 25 (renewal of a fixed-term lease)
  • Zakon o najmu stanova (NN 91/96, 48/98, 66/98, 22/06, 68/18, 105/20, 36/24), art. 19 to 22 (landlord's grounds, notice periods and form)
  • Zakon o obveznim odnosima (NN 35/05, 41/08, 125/11, 78/15, 29/18, 126/21, 114/22, 156/22, 155/23, 69/26), art. 551, 570, 573 and 576 (lease rules that apply where the Residential Lease Act is silent)
