Move-in inventory report template for Austria

Handover report (move-in and move-out) · Übergabeprotokoll (Wohnungsübergabe und Wohnungsrückstellung)

The report that records the condition of a rented flat, room by room, with meter readings, keys, appliances and defects, when the tenant moves in and again when the tenant returns the flat. Both parties sign it. It is the main evidence in a dispute over the deposit.

Use it on the day the tenant takes over the keys and again on the day the tenant returns them. Fill in one copy for each occasion, walk through every room together and take dated photos. Austrian law does not require a report or prescribe its form, but the tenant must return the flat in the condition received, so both sides need proof of that condition.

Reviewed October 28, 2026. Not legal advice. Have a notary or lawyer check your case before you sign.

Key facts

Applies to
Whole country
Legal form
None. The report is evidence, not a statutory document.
Condition at return
As received, or as stated in an inventory (ABGB § 1109). The tenant answers for damage and misuse, not for normal wear (ABGB § 1111).
Normal wear
The tenant does not pay for it. Examples from case law: drill holes after removing shelves, a scratch in the bath, common wall colours.
Landlord's damage claims
Must be brought in court within 1 year after the flat is returned, or they lapse (ABGB § 1111).
Keys
Hand them over in person. Keys posted in the letterbox are not a proper return, and the landlord can charge a use fee.
Deposit
For a lease under the MRG, returned with interest without delay after the lease ends, less justified claims (MRG § 16b(2)).
Heating boiler
Routine servicing is the tenant's duty. Repair and replacement of a boiler let with the flat are the landlord's.
Boiler exception
The landlord's boiler duty does not apply in some houses with no more than two flats let after 31 March 2001.

Formalities

  1. No form, witness or fee is required.
  2. Both parties, or their representatives, sign every page or the last page. Each keeps a copy.
  3. Attach the photos and list them by number.

Common mistakes

  • Skipping the move-in report. Without it, the landlord and the tenant argue at move-out about defects that may have existed from the start.
  • Writing "in gutem Zustand" for a whole room. Note each wall, floor, window and fitting, and name each defect with its place and size.
  • Posting the keys instead of handing them over. The flat is then not properly returned, and the landlord can charge a use fee.
  • Charging the tenant the full cost of a new floor or new paint after many years. Damages are based on the current value of the worn item, not the new price.
  • Forgetting the meter readings. They decide the final bills for electricity, gas and heating.
  • Leaving the date of the last boiler service out. The landlord may later blame a breakdown on missing servicing.

Legal basis

  • Allgemeines bürgerliches Gesetzbuch (ABGB), § 1109 (return of the let property)
  • ABGB, § 1111 (tenant's liability for damage, one-year deadline)
  • Mietrechtsgesetz (MRG), § 16b (deposit)
